Request for Waiver of Overpayment of Salary

An employee appealed a settlement denying a waiver of erroneous payments of overtime pay. The employee, who was transferred to agency headquarters, continued to receive payments for administratively uncontrollable overtime which was no longer authorized. The waiver was granted since the employee had notified his supervisor and the personnel office and had been advised that the payments were proper. It did not appear that the employee should have known that the overtime terminated upon transfer to headquarters nor did it appear that the employee acted unreasonably in relying upon the erroneous information provided by officials who he presumed were knowledgeable.
