Request for Waiver of Overpayment of Basic Compensation
Highlights
An employee requested reconsideration of a determination denying his request for waiver of an erroneous payment of compensation. The wage grade employee, who received $7.45 per hour including overseas differential while stationed on Guam, continued to receive that rate when transferred to Norfolk, Virginia. When the employee questioned the rate of pay, he was advised that it was due to the "saved pay" provision and relied on that information. The amount of $536.82 was waived since the employee, who had no special knowledge of personnel law, reasonably relied on information provided him. However, the remaining $188.68 was not waived since it represented amounts paid him after he was advised that he had been overpaid.
