An agency official recommended waiver of recovery of overpayments made to a member's widow resulting from erroneous annuity payments under the Survivor Benefit Plan. The waiver may not be considered under 10 U.S.C. 2774, which relates to pay and allowances, but may be considered under 10 U.S.C. 1453. According to established criteria, waiver may be granted if collection would be contrary to the purpose of the plan and against equity and good conscience. Proof of financial hardship is not required if the waiver is otherwise proper.
