Highlights

A former employee claimed unused sick leave accrued prior to her retirement. The claimant became ill shortly before her separation and discontinued-service retirement for refusal to accompany her position incident to a transfer of the function. Her retirement was later changed to a disability retirement. Although the claimant alleged that she was erroneously advised as to her options, she may not be restored to the rolls for the purpose of taking unused sick leave since the leave was included in the computation of her annuity and, therefore, may not be restored. The record also indicated that the claimant applied voluntarily for the discontinued-service retirement for personal reasons.
