Highlights

The contractor requested relief under a contract on the basis of a mistake in bid alleged after award. The contractor was not entitled to a price increase where the contracting officer had no actual or constructive notice of the mistake prior to award. The variation of 5.6 percent between the low and the next low bid was not sufficient in itself to constitute constructive notice of the possibility of an error where a broad range of bids was received.
