The agency requested a decision as to the entitlement of a new employee to backpay incident to a delay in his date for reporting to duty. The new employee's entry on duty was delayed by 2 weeks because the agency failed to comply with the terms of its union agreement requiring posting of vacancy announcements for 15 days and automatic consideration of all eligible employees for any vacancy. The employee was not entitled to pay for the 2-week period in question since there was no administrative finding that he suffered withdrawal or reduction in pay as the result of an unjustified or unwarranted personnel action as required by the Back Pay Act.
