A firm objected to the award of a contract, alleging that the award violated its legal patent and that the awardee's offered part was improperly included as an approved source in the solicitation. The question of patent infringement was not for consideration by GAO since it involved a matter of contract performance. The protest regarding the inclusion of the awardee's part as an approved source in the solicitation was untimely and not for consideration since the protest was not filed before the closing date for the receipt of proposals or within 10 working days of receipt of notice of the agency's denial of the protest.
