The protester objected to the award of a contract, alleging that the successful bidder submitted a nonresponsive offer. The protest was untimely and not for consideration on its merits since it was filed more than 5 days after notification of the agency's denial of a similar protest to the agency. The protester's inability to acquire a copy of the Bid Protest Procedures provided no basis for exemption from the timeliness rule since publication of the procedures in the Federal Register constituted constructive notice.
