Forfeiture of Accrued Annual and Sick Leave

A former employee requested reconsideration of the disallowance of his claim for payment for sick and annual leave forfeited at the time of his optional retirement. The claimant was not entitled to payment of the sick leave accrued as of the effective retirement date since there was no statutory authority for paying an employee for accrued sick leave. The employee was not entitled to reimbursement of the accrued annual leave since the employing agency authorized by regulations to make a determination as to whether an administrative error occurred in the forfeiture of the leave found that no error had been made.
