An advance decision was requested concerning a female member's claim for dislocation, travel, and quarters allowances on account of her son whose father was also a member. She was married to and resided with the father who received basic allowance for quarters (BAQ) at the with dependents rate on account of children of a previous marriage. The claimant was not entitled to BAQ at the with dependents rate for the child of the present marriage since the child must be considered a dependent of the spouse who was receiving BAQ at the with dependents rate, and there was no basis for allowing both spouses to receive BAQ at that rate. She may receive a travel allowance for travel of the child incident to a change of permanent station of both members since the child is the female member's dependent under 1 J.T.R., para. M1150-9. Only one dislocation allowance may be paid for moving both members' household to the same location and, since the male member has already received such allowance, the female member's claim must be denied. However, if the dislocation allowance paid to the male (junior) member is repaid, a greater amount may be paid to the female (senior) member.
