A Congressman contacted GAO regarding a letter sent by a protester to GAO requesting an investigation of the procurement practices of the Naval Supply Center at Norfolk, Virginia. The letter was apparently lost. However, GAO could not at any time have reopened the protester's case and conducted the type of investigation which the protester requested. GAO does not conduct independent investigations to establish the validity of protesters' speculative statements. Moreover, all of the issues raised by the protester were either untimely, unsubstantiated, or of a type not reviewed by GAO. The Congressman also questioned the fact that GAO did not give the protester an opportunity to comment on the Navy's response to the protest. Where the initial submission of a protest indicates that a protest is untimely, without legal merit, or states a basis for protest which is not considered by GAO, a decision or dismissal may be issued without obtaining such a response. These circumstances prevailed in the instant case, and no useful purpose would have been served by pursuing the matter any further.
