The Commission on the Bicentennial of the United States Constitution requested a decision on whether the Commission could retain the proceeds from the licensing of the Commission's logo and from sales of publications bearing that logo. GAO held that the Commission: (1) had no authority to retain the proceeds from the sale of publications directly to the public and that such proceeds must be deposited into the Treasury as miscellaneous funds; and (2) is authorized by its statute to retain and expend proceeds from the commercial licensing of its logo for authorized Commission purposes, subject to the same restrictions and limitations applicable to the use of all appropriated funds.
