    Comments: As of June 2017, FCC indicated that it is taking steps to hold joint outreach and training efforts with USDA when feasible and FCC plans to document those efforts over the next year. GAO will continue to monitor the status of FCC's efforts.
    Recommendation: To help improve and measure the availability and adoption of high-speed Internet on tribal lands, the Chairman of the Federal Communications Commission should improve the reliability of FCC data related institutions that receive E-Rate funding by defining "tribal" on the program application.

    Comments: As of June 2017, FCC reiterated that it agrees with this recommendation and is working on developing a definition for "tribal" that it can use. FCC hopes to have the definition developed, approved, and put into use by Spring 2018.

    Recommendation: To more clearly communicate what NTIA hopes to achieve with its ongoing broadband adoption efforts and to demonstrate the agency's progress, the Secretary of Commerce should include in NTIA's annual performance plan a quantifiable outcome-based performance goal and a related performance indicator for the agency's broadband adoption efforts consistent with the strategic plan.

    Comments: In responding to the recommendation in a draft of the report, the Department of Commerce stated that it agrees that outcome-based performance tools are important in evaluating the success of an agency program. However, it also stated that an outcome-based measure would not be an accurate measure of NTIA's performance because the agency's ongoing efforts to provide technical assistance to communities to support broadband adoption efforts are advisory and do not provide funding to communities. In August 2016, an NTIA official reiterated this position. We will continue to monitor NTIA's activities in this area, in case its broadband adoption efforts change.

    Comments: The General Services Administration (GSA) has not addressed this recommendation. In June 2014, the agency reported that it had coordinated with OPM to incorporate key objectives in its NS2020 strategy to address and mitigate challenges with regards to government-wide expertise needed to execute the NS2020 program. However, as of May 2017, GSA had not demonstrated that it had studied potential government-wide telecommunications expertise shortfalls or used the study to shape the NS2020 strategic approach.
    Recommendation: To improve planning and execution of the next telecommunications transition, the Administrator of General Services should ensure that the lessons are applied, based on priority and available resources, to the next transition strategy.

    Comments: The General Services Administration has not implemented this recommendation but has taken steps to address it. In April 2014, the agency developed a strategy for transitioning to the next telecommunications contract vehicle. The strategy described the lessons learned that contributed to the delay in the prior transition and identified approaches the agency planned to take to apply the lessons learned. For example, it identified high level plans for addressing the need for improved management of the complex acquisition process and the need for technical and contracting telecommunications expertise across the government. As of August 2016, GSA had prioritized the lessons learned and considered the resources needed to apply them. However, as of May 2017, the agency had not demonstrated that it had ensured that the lessons were applied, based on priority and available resources, to the next transition strategy. We will continue to monitor GSA's efforts to implement the recommendation.

    Recommendation: The Chairman of the FCC should formally reassess the current RF energy exposure limit, including its effects on human health, the costs and benefits associated with keeping the current limit, and the opinions of relevant health and safety agencies, and change the limit if determined appropriate.

    Comments: The Federal Communications Commission (FCC) is developing a record on radiofrequency (RF) exposure limits with a Notice of Inquiry (in dockets 13-84 and 03-137). In the Inquiry, FCC requested comment to determine whether the RF exposure limits and policies need to be reassessed. FCC has not issued any further actions related to this inquiry, and does not have a schedule to resolve the issues in the open proceeding.
    Recommendation: The Chairman of the FCC should reassess whether mobile phone testing requirements result in the identification of maximum RF energy exposure in likely usage configurations, particularly when mobile phones are held against the body, and update testing requirements as appropriate.

When the notice of proposed rulemaking is issued, we will assess the extent to which it addresses this recommendation.
    Recommendation: The Federal Communications Commission should work with Congress, as necessary, to determine what the long-term role of Class A stations should be, whether additional low-power television stations should be permitted to apply for Class A status, and what criteria stations must meet to qualify for such status. Such criteria could include attributes that contribute to FCC's goals of serving underserved communities and enhancing localism and diversity, such as providing locally produced programming and programming otherwise unavailable to communities.

    Comments: In its February 5, 2010 response, FCC stated that it would consider establishing meaningful and measurable outcome-based standards in the context of its efforts to reassess goals for the mediation of informal consumer complaints. FCC noted that it already has basic performance metrics for responding to consumer complaints in a timely manner and will examine ways to automate such responses and provide them by email, which may be more efficient than processing these complaints manually and mailing a paper response. In June 2011, FCC stated it had taken steps to improve its complaint-handling efforts by increasing staff training and beginning an effort to revise its complaint coding and intake process, which it expects to complete by the end of fiscal year 2011. FCC also stated it is considering other enhancements for fiscal year 2012. However, this response did not mention any direct action in response to the recommendation. In May 2012, FCC stated it had begun an effort to improve its informal complaint-handling, including revising its complaint intake and coding procedures with an emphasis on collecting information to enhance policymaking and compliance activities. The response did not specifically mention goals and measures, but said the effort was ongoing and expected to continue through the end of 2012. In August 2013, FCC stated it was considering a proposal for comprehensive reform to its consumer complaint process. The agency hoped to institute performance measures for the consumer complaint process as part of the reform. In June 2014, FCC staff said that the FCC Chairman had set a goal to reform the agency's complaint process by the end of 2014. In August 2016, FCC staff said that the agency is working to develop performance metrics for its complaint-handling efforts. We will continue to follow up with FCC about its efforts.
    Recommendation: To better ensure a systemwide focus in providing oversight of wireless phone service and improve FCC's partnership with state agencies that also oversee this service, the Chairman of the Federal Communications Commission should direct the commission to develop and issue guidance delineating federal and state authority to regulate wireless phone service, including pulling together prior rulings on this issue; addressing the related open proceedings on truth-in-billing and early termination fees; and, if needed, seeking appropriate statutory authority from Congress.

    Comments: In its February 5, 2010 response, FCC noted that the Notice of Inquiry on Consumer Information and Disclosure it released on August 9, 2009, provides an opportunity for the agency to review prior rulings and related open proceedings. The response also stated that FCC's Wireless Bureau and Consumer and Governmental Affairs Bureau are working together to review areas of the Communications Act where clarification is needed regarding state and federal roles for oversight of wireless phone service. In June 2011, FCC stated that it was continuing to hold regular meetings with associations representing state agency officials, but did not mention taking any action to directly address the recommendation. In May 2012, FCC stated that the topic of wireless regulation is discussed during intergovernmental webinars FCC hosts with state and local government offices, but did not indicate it had developed and issued guidance as called for in the recommendation. In August 2013, FCC stated that it has not issued any formal guidance on delineating federal and state wireless oversight authority. In June 2014, FCC stated that the commission was considering making changes to its truth-in-billing rules by the end of 2014 and that such a proceeding would include addressing how FCC partners with states in protecting wireless consumers. In July 2016, FCC said that it planned to address this issue in December 2017.

    Comments: In an August 2007 order, FCC adopted two performance measures for the E-rate program, one for Internet connectivity and the other for application processing. The order did not include specific E-rate program goals, although FCC said in this order that it anticipated adopting performance goals as it and USAC gained experience with the performance measures. While FCC's efforts to develop performance measures have the potential to eventually produce better information than is currently available on E-rate program performance, these measures fall short when compared to the key characteristics of successful performance measures and FCC still has not established program goals. FCC says it is still working on developing goals and performance measures for the Universal Service programs.
