    Recommendation: As Congress considers reauthorizing NFIP, it should consider comprehensive reform to improve the program's solvency and enhance the nation's resilience to flood risk, which could include actions in six areas: (1) addressing the current debt, (2) removing existing legislative barriers to FEMA's revising premium rates to reflect the full risk of loss, (3) addressing affordability, (4) increasing consumer participation, (5) removing barriers to private-sector involvement, and (6) protecting NFIP flood resilience efforts. VA is developing a new framework to address the people, processes, technology, and performance monitoring mechanisms identified in the Information Security Continuous Monitoring (ISCM) Maturity Model. This framework and supporting program plan are linked to the Department of Homeland Security Continuous Diagnostics and Mitigation (CDM) phase 1 deployment that is ongoing and anticipated to be completed by the fourth quarter of 2017. VA's ISCM program plan and framework have been delayed to accommodate these changes.
    Recommendation: To improve security over federal systems, including those considered to be high impact, the Director of the Office of Management and Budget should issue plan and practices specified in the Cybersecurity Strategy and Implementation Plan.

On December 9, 2016, OMB issued memorandum M-17-09, Management of Federal High Value Assets, which lists some existing policies and guidance and other actions that agencies need to take to protect IT assets. GAO is requesting further access to this document on best practices in order to determine whether OMB has adequately addressed the recommendation.

    Recommendation: To encourage plan sponsors to continue efforts to improve plan participation and overall retirement savings through the use of Qualified Default Investment Alternatives, the Secretary of Labor should direct the Assistant Secretary for the Employee Benefits Security Administration to assess the challenges that plan sponsors and stakeholders reported, including the extent to which these challenges can be addressed, and implement corrective actions through clarifying guidance or regulations, as appropriate.

    Comments: In 2015, DOL noted that the agency would assess the challenges that plan sponsors and stakeholders had reported to GAO, decide in FY 2016 whether a broader public comment process (such as a Request for Information) or a research project would aid that assessment, and determine whether other actions, such as issuing clarifying guidance or regulations, would be beneficial to its stakeholders. In July 2016, DOL confirmed that the agency continues to plan to take the above action. In July 207, DOL responded that it had not added a public comment process to EBSA's 2017 regulatory agenda, and had no specific timeline for any next action.

    Recommendation: To assist in determining progress toward a long-term, sustainable portfolio, the Administrator of GSA should identify the gap between the portfolio's current level of performance and the level necessary to sustain the portfolio. As part of this effort, GSA should review its tiering and core asset analysis measures and update them to provide more precise measures that can be used in identifying this performance gap.

    Comments: As of June 2017, GSA has developed an Asset Repositioning Tool to build upon and replace its tiering and core asset analysis measures. The tool uses 10 measures of asset performance related to customer, asset, and market indicators to determine an asset's performance. According to GSA, the tool allows for a more refined analysis in determining an asset's performance and enables GSA to identify and rank assets that should be held long-term and those which are low-performing and should be studied to determine their future place in the portfolio. GSA intends to use the tool at the start of every fiscal year to analyze its portfolio and use the results to inform its investment decisions and decisions to hold or dispose of lower-performing assets. GSA believes that use of the tool to support its asset management practices will enable it to better assess the performance gap within and take actions to promote the sustainability of its portfolio. GAO will continue to monitor GSA's efforts to implement this tool in assessing asset performance and using the results to work toward establishment of a long-term, sustainable portfolio.

    Recommendation: To strengthen USPS's capital investment process related to USPS policy and consistent application of leading practices, the Postmaster General and executive leaders should establish a time frame for developing a clear, detailed, single-source, standard set of policies and procedures that reflect the capital investment selection phase.

    Comments: In June 2017, the U.S. Postal Service (USPS) informed GAO that its Handbook F-66 General Investment Policies and Procedures is undergoing revisions that will make the capital investment selection process more clear, detailed, and standardized. The revised draft of the F-66 handbook is currently in the review and clearance process and may be finalized in 2017. USPS added that it will inform GAO of further updates as they develop.
    Recommendation: To strengthen USPS's capital investment process related to USPS policy and consistent application of leading practices, the Postmaster General and executive leaders should modify capital investment policies to more closely align with the following leading practices, including: (1) for planning capital investments, consider whether an external entity could better support all or part of a desired function when evaluating alternative capital investment options; (2) for selecting capital investments, use a portfolio approach for developing business cases and finalizing and allocating resources; and (3) for evaluating capital investments, seek and leverage external oversight and review, from a consultant or peer reviewer, and require that best practices and lessons learned be incorporated into the review process.

    Status: Open

    Comments: In June 2017, USPS informed GAO and provided documentation that its Handbook F-66 General Investment Policies and Procedures is to incorporate all leading practices. The F-66, however, is not yet finalized. In particular, the draft F-66 states that for planning investments, USPS is to conduct an analysis to identify the most economically beneficial resolution to a problem--the alternative that will result in the highest net present value, lowest costs, or greatest savings. For selecting investments, USPS is to use a portfolio approach organized by agency goals, sub-goals, indicators, and targets. For evaluating investments, USPS is to evaluate the need to hire consultants when applicable to assess the investment. The revised F-66 indicates that USPS will also is require project managers to submit an analysis of investment performance and lessons learned as part of its post-deployment steps.
    Recommendation: To strengthen USPS's capital investment process related to USPS policy and consistent application of leading practices, the Postmaster General and executive leaders should regularly examine the extent to which executives and program managers consistently follow all leading practices, particularly for: (1) identifying problems and reassessing risk while managing a project; and (2) evaluating the cost, schedule, and performance results of completed projects.

    Comments: In June 2017, USPS informed GAO and provided documentation that its revised Handbook F-66 General Investment Policies and Procedures is to include a management step to regularly review the progress and benefits of its capital investments, as well as its affordability and achievability, and make adjustments as necessary to meet the investment's goals. In addition, once a project is completed, USPS will require capital investment managers to present on the investment's performance, return-on-investment, and lessons learned.

    Recommendation: To strengthen FHA accountability for complying with the Fund's statutory capital requirement, Congress should consider requiring that FHA submit a capital restoration plan and regular updates on plan implementation whenever the capital ratio falls below 2 percent as calculated in the annual actuarial review of the Fund, or the Fund's financial condition does not meet other congressionally-defined requirements.

    Recommendation: To enhance DOD's capability and capacity to accomplish the missing persons accounting mission, and to clarify the specific roles and responsibilities of the accounting community members to help minimize unnecessary overlap and disagreement among community members, the Secretary of Defense should direct the Secretary of the Air Force and direct the Commander, U.S. Pacific Command, or the appropriate departmental entity in light of any reorganization, to negotiate a new memorandum of agreement between the Life Sciences Equipment Laboratory and Joint Prisoner of War/Missing in Action Accounting Command (JPAC). The memorandum should specify which conflicts' artifacts JPAC should send to the Life Sciences Equipment Laboratory for analysis, the type of artifacts sent, and the priorities according to which the Life Sciences Equipment Laboratory should analyze resolved cases.

    Comments: Officials from the Defense POW/MIA Accounting Agency (DPAA) stated that the Life Sciences Equipment Laboratory (LSEL) and the former JPAC Central Identification Laboratory (CIL) have both been absorbed into DPAA, so there is no need for a separate memorandum between the two entities. We believe that DPAA should take actions that would meet the intent of our recommendation by delineating the roles and responsibilities within DPAA of the former LSEL and CIL laboratories. As of September 2017, DPAA has taken some actions to clarify which conflicts and types of artifacts the different laboratories are responsible for working on. For example, according to DPAA officials, DPAA has made progress in bringing the former LSEL up to the standard of the other DPAA laboratories by developing an evidence control system and a formal inventory. In addition, the DPAA laboratories have updated their standard operating procedures to specify the format and procedures for writing life science equipment material evidence reports, which should address the concerns identified in our report related to the length and utility of these reports prepared by one of the laboratories. However, a DPAA official stated that DPAA is rethinking how different laboratory functions should be performed and where those capabilities should reside, and that a decision about the future course of action would likely be made in fiscal year 2018. Until the responsibilities of the different DPAA laboratories are clarified with regard to which conflicts and types of artifacts the different laboratories are responsible for working on, the potential for inefficient and ineffective interactions between the different laboratories that we identified in our 2013 report may continue.
    Recommendation: To enhance DOD's capability and capacity to accomplish the missing persons accounting mission, and to more efficiently and effectively develop the capability and capacity to account for missing persons, the Secretary of Defense should direct the Office of the Under Secretary of Defense (Policy), or the appropriate departmental entity in light of any reorganization, to ensure that the Defense Prisoner of War/Missing Personnel Office (DPMO), in coordination with all members of the accounting community, develop personnel files for all unaccounted for persons as required by statute, in order to help avoid potential overlap or unnecessary duplication of effort and to ensure better communication among community members with respect to missing persons cases.

    Comments: As of September 2017, this recommendation has not been implemented and remains open. The Defense POW/MIA Accounting Agency (DPAA) is taking actions to develop case files for all persons who are unaccounted for. As of May 2017, DPAA officials said that DPAA had completed the case files for all individuals from the Vietnam War; about 80 percent of the files for individuals from the Korean War; and about 60 percent of the files for individuals from World War II. The officials said that DPAA has an ongoing effort to develop a case management system and scanning project that will serve as the basis for the required personnel or case files, but they have faced funding challenges that have hindered their ability to finish this project. They said that if DPAA can get the necessary funding, they will be able to complete development of all of the files in about 2 years. They said that with a lower level of funding, it will take more time than that 2 year estimate, and potentially could cost more money over time. Until personnel files for all unaccounted-for missing persons are developed and made readily accessible, as required by law, the community?s efforts to collaborate on cases will be hindered by a lack of information visibility among community members.

FEMA also said it would explore technological advancements and engage with industry to determine the availability of technology, building information data, readily available elevation data, and current flood hazard data that could be used to implement the recommendation. However, FEMA officials also said that the agency faced a cost challenge with respect to elevation certificates and that obtaining these certificates could take considerable time and cost. They noted that requiring policyholders to incur the cost of obtaining elevation certificates would not be consistent with NFIP's policy objective to promote affordability. As a result, the repository does not yet include all the data that were planned to be incorporated by the end of 2012, and efforts to add the remaining states' Medicaid data to IDR continue to be behind schedule. As of March 2017, agency officials are working to develop plans to integrate all states' data into IDR as part of ongoing program integrity initiatives.

    Comments: As of March 2017, CMS officials reported that they have identified areas of potential cost savings to be achieved by requiring program integrity contractors to use IDR and One PI, as GAO recommended in June 2011. CMS is awarding new contracts to include this requirement, which is expected to result in the agency no longer funding contractors' efforts to establish and maintain their own data warehouses and analytical tools. However, not all of the contracts have been awarded and, therefore, the requirement has not been fully implemented. Until all the new contracts have been awarded that require the contractors to use IDR and One PI for program integrity purposes, CMS will not have reasonable assurance that using the systems will help improve CMS's ability to detect fraud, waste, and abuse in the Medicare and Medicaid programs, and to achieve the $21 billion in financial benefits program officials projected.

    Recommendation: To improve compliance with shareholder basis rules, Congress may wish to require S corporations to calculate and report shareholder's stock and debt basis as completely as possible. S corporations would report the calculation on the Schedule K-1 and send it to shareholders as well as IRS. If Congress judges that stock purchase price information that is currently only available to shareholders should not be transmitted to the S corporation due to privacy concerns, an alternative is to require that S corporations report less complete basis calculations using information already available to the S corporation.

    Comments: IRS is researching sole proprietor noncompliance, as GAO recommended in September 2009. It is focusing on those who improperly claim business losses (i.e., not profits). IRS's Office of Research, Analysis and Statistics is using the reporting compliance study of Form 1040 filers to gather the data on such noncompliant business losses. This research covered sampled tax returns filed for tax years 2009, 2010, and 2011 and used audits of the sampled tax returns that are filed for each tax year. In November 2016, IRS research officials provided the initial rough estimates of the percentage of disallowed losses and associated dollar amounts for all 3 tax years but as of March 2017, they had not yet indicated how these estimates helped IRS to understand the nature of the tax noncompliance. The officials cautioned that their ability to develop the estimates depends on the number of observations that can be applied from each tax year. This research, when completed, could help IRS to identify noncompliant sole proprietor issues and take action to reduce losses.

    Comments: As of January 2017, FEMA is taking steps to verify the accuracy of flood probabilities by collecting and analyzing data from flood insurance studies. FEMA is also continuing to monitor the completion of these studies to determine when a statistically valid amount of data is available so that it can better assess flood risk. To verify the accuracy of damage estimates, FEMA is collecting data required to revise its estimates of flood damage and is undertaking studies to determine factors beyond flood water depth that contribute to flood damage. FEMA will incorporate that information into its rate-setting methodology as the necessary data becomes available. To verify the accuracy of flood maps, FEMA continues to reassess flood risk, evaluate coastal flood maps, and update its overall map inventory. To ensure that flood probabilities reflect long-term and ongoing planned development and climate change, FEMA is working with the Technical Mapping Advisory Committee to ensure the best available information on flood probabilities is used for rate-setting. In addition, as FEMA collects information on flood probabilities, it will conduct analyses to evaluate the practice of classifying risk across zones.

OMB did not agree that GAO's September 2005 recommendation is necessary and stated that presenting information on tax expenditures together with related outlay programs is not useful for budgeting and that such a presentation is not part of the congressional budget process. However, the Congressional Budget Act of 1974 requires a list of tax expenditures, including special tax credits, deductions, exclusions, exemptions, deferrals, and preferential tax rates. Whereas OMB favors reporting tax expenditures separately from the rest of the budget, GAO has reported that an integrated presentation is also useful to show the relative magnitude of tax expenditures compared to spending and credit programs across mission areas. OMB previously presented tax expenditure sums alongside outlays and credit activity for each budget function in the federal budget from fiscal year 1998 through fiscal year 2002, but discontinued the practice. Tax expenditures resulted in $1.4 trillion in forgone revenue in fiscal year 2016, more than the discretionary spending level that year.

However, in its June 2015 update of this guidance, OMB removed the language about working with Treasury and agencies to align tax expenditures with agency goals. OMB staff told GAO in July 2017 that it was not an effort they were pursuing due to competing priorities, as well as capacity and resource constraints.
