    Recommendation: To address the increased risk posed by new gathering pipeline construction in shale development areas, the Secretary of Transportation, in conjunction with the Administrator of the Pipeline and Hazardous Materials Safety Administration, should move forward with a Notice of Proposed Rulemaking to address gathering pipeline safety that addresses the risks of larger-diameter, higher-pressure gathering pipelines, including subjecting such pipelines to emergency response planning requirements that currently do not apply.

    Priority recommendation

    Comments: PHMSA has drafted proposed regulations for both gas and hazardous liquid gathering pipelines. Specifically, PHMSA published Notices of Proposed Rulemaking to separately address safety issues associated with hazardous liquid gathering pipelines in October 2015 and gas gathering pipelines in April 2016. These proposed regulations partly address our recommendation by proposing new rules to address risks posed by new gathering pipeline construction, but do not fully address our recommendation to subject these pipelines to emergency response planning requirements, particularly for hazardous liquid pipelines. As of October 2016, PHMSA has determined that it needs one year's worth of data before it can begin assessing what regulations are needed to fully address the risks of hazardous liquid pipelines.

    Recommendation: To improve the resilience of the nation's infrastructure to climate change, the Executive Director of the United States Global Change Research Program or other federal entity designated by the Executive Office of the President should work with relevant agencies to identify for decision makers the "best available" climate-related information for infrastructure planning and update this information over time.

    Recommendation: To improve the resilience of the nation's infrastructure to climate change, the Executive Director of the United States Global Change Research Program or other federal entity designated by the Executive Office of the President should work with relevant agencies to clarify sources of local assistance for incorporating climate-related information and analysis into infrastructure planning, and communicate how such assistance will be provided over time.

    Recommendation: To improve the resilience of the nation's infrastructure to climate change, the Chairman of the Council on Environmental Quality should finalize guidance on how federal agencies can consider the effects of climate change in their evaluations of proposed federal actions under the National Environmental Policy Act.

    Comments: On August 1, 2016, the Council on Environmental Quality (CEQ) issued final guidance to federal departments and agencies on how to consider the effects of greenhouse gas emissions and climate change when evaluating proposed federal actions in accordance with the National Environmental Policy Act. However, in March 2017, the White House issued Executive Order 13783, directing CEQ to rescind the guidance, among other things. CEQ rescinded the guidance on April 5, 2017.

    Recommendation: As the Chair of the Committee on the Marine Transportation System, the Secretary of Transportation should ensure the review and update, as needed, of the National Strategy for the Marine Transportation System. In ensuring the review and update of the National Strategy for the Marine Transportation System, the Secretary should (1) establish accountability mechanisms--such as developing clear and desired results, specific milestones, and outcome-related performance measures--for the recommended actions of the National Strategy for the Marine Transportation System, and (2) establish and implement a schedule for regular reporting of progress made in addressing the recommended actions of the National Strategy for the Marine Transportation System.

    Recommendation: To better ensure consistent implementation of and accountability for DHS's resilience policy, the Secretary of Homeland Security should direct the Assistant Secretary for Policy to develop an implementation strategy for this new policy that identifies the following characteristics and others that may be deemed appropriate: (1) steps needed to achieve results, by developing priorities, milestones, and performance measures; (2) responsible entities, their roles compared with those of others, and mechanisms needed for successful coordination; and (3) sources and types of resources and investments associated with the strategy, and where those resources and investments should be targeted.

    Comments: In the 60-day letter provided in January 2013, DHS indicated that the Resilience Integration Team (RIT) was developing a draft implementation plan to be circulated among relevant stakeholders for review. On 10/30/13, we notified DHS that we would like to see a copy of the resilience policy implementation plan (if developed), or any other related documentation if the plan is still in development. We were informed later that day that a draft plan had been developed, and DHS needed to confirm its status. In May of 2015, we were told again that a draft plan had been developed but never finalized. As of August 2015, DHS's Policy Office is looking into the status of plan development. We await their response. DHS response still pending as of 10/4/16.

    Recommendation: In order to encourage vehicle owners to comply with safety recalls, provide vehicle owners with specific information about whether their vehicle is involved in a recall, and identify factors that affect recall completion rates, among other things, the Secretary of Transportation should direct the Administrator of NHTSA to develop a plan to use the data it collects on recall campaigns to analyze particular patterns or trends that may characterize successful recalls and determine whether these represent best practices that could be used in other recall campaigns.

    Recommendation: To improve FTA's ability to determine the extent to which transit grants, current formula incentives, and FTA program activities have had a positive effect on local transit agency performance--and to the extent that FTA finds current data sources to be appropriate and reliable for such purposes-- the Secretary of Transportation should direct the FTA Administrator to further analyze and use data submitted to FTA by local transit agencies. As part of this analysis, FTA may want to identify and evaluate, when applicable, (1) the extent to which transit grant programs are accomplishing their established goals; (2) the areas of performance in which FTA should concentrate its program activities to increase the performance of local transit agencies and the federal transit program in general; and (3) the extent to which formula incentives and other performance accountability mechanisms have influenced the activities and performance of local transit agencies.

    Comments: As of November 2017, FTA had published the final National Safety Plan and a final rule on state of good repair for transit assets. However, the final Public Transportation Agency Safety Plan rule is under additional review per the transition in administration. FTA does not expect publication until Spring 2018. We will continue to monitor DOT actions pertaining to this rulemaking.

    Recommendation: To support the triennial review program's goal of having grantees consistently meet more federal requirements, the Secretary of Transportation should direct the FTA Administrator to meet standards set forth in previous GAO work, based on the Government Performance and Results Act of 1993, and develop performance measures to assess: (1) the outcomes of the triennial review program, such as a method for evaluating improvements in grantee performance in meeting more federal requirements over time (2) and the quality of the triennial review through improved contractor oversight, testing, or inspection.

    Comments: Federal Transit Administration (FTA) responded to our recommendations stating that it plans to improve the quality of oversight reviews. Actions aimed to improve quality are: (1) increasing oversight of contractors by emphasizing regional and headquarters' participation in all on-site triennial reviews and (2) increasing annual oversight conference participation and quarterly review workshops that focus on improving performance measures. These activities were to be specified in new procedures coming out in 2011.
    Recommendation: To support the triennial review program's goal of having grantees consistently meet more federal requirements, the Secretary of Transportation should direct the FTA Administrator to improve the objectivity and reliability of the "Close Findings Timely" performance measure by: (1) developing an internal controls process to verify grantees have satisfactorily resolved findings before closing them (2) continuing to emphasize the use of OTRAK across all regions and developing a process to close out triennial reviews in OTRAK upon grantees' completion of corrective actions.

    Comments: Federal Transit Administration (FTA) is working to strengthen the internal control process for closing out triennial review findings. Specifically, it is drafting operating procedures indicating that (1) the regional offices have the primary responsibility to provide the necessary technical assistance to grantees to close-out findings as well as ensure the findings are not closed-out prematurely and (2) program managers have a secondary responsibility to verify whether the findings were closed out properly. The procedures were to be issued in October 2010.
    Recommendation: To support the triennial review program's goal of having grantees consistently meet more federal requirements, the Secretary of Transportation should direct the FTA to ensure that additional outcome and quality performance measures are balanced with the existing measures for assessing the timeliness of the triennial review program so that one priority is not emphasized at the expense of others.

    Comments: Federal Transit Administration (FTA) anticipates adding a performance measurement, called reduction in repeat findings, that relates to assessing the quality of the review. FTA officials told us that this new performance measurement is noncontroversial and was to be discussed at a June 2012 Oversight Meeting.
