    Recommendation: To improve the quality and transparency of statistical reporting of international government procurement by GPA and U.S. FTA parties to fulfill their commitments under these agreements, the U.S. Trade Representative should prepare and submit a proposal to the WTO GPA working group on statistical reporting established by the Committee on Government Procurement that aims to improve the quality of statistical reporting by WTO parties to address the weaknesses we identified.

    Comments: On May 10, 2017 USTR officials said the United States has long struggled with the challenges associated with comparing statistics produced by the United States with statistics provided by U.S. trading partners where there are inconsistencies in statistical reporting. To respond to this known challenge, USTR led an effort to establish a work program on statistical reporting during the revised GPA negotiations. The WTO GPA statistical work program calls for parties to make recommendation on four issues: 1) whether the GPA Parties should adopt a common method for collection of statistics; 2) whether the GPA Parties are able to standardize the classifications in the statistical data reported to the GPA Committee; 3) means for facilitating the collection of country of origin of goods and services covered by the agreements; and 4) other technical issues in government procurement data reporting raised by any GPA Party. In 2017, USTR assumed the chair of the work program as part of its effort to ensure that the GPA Parties continue to make progress in their work on these recommendations. On April 27, 2017, USTR tabled a proposal that identifies outstanding issues preventing GPA Parties from improving the quality of statistical reporting. GPA Parties have agreed to discuss these issues at another work program meeting chaired by USTR in June 2017.
    Recommendation: To improve the quality and transparency of statistical reporting of international government procurement by GPA and U.S. FTA parties to fulfill their commitments under these agreements, the U.S. Trade Representative should resume the annual exchange of statistical data on covered government procurement with the other NAFTA parties as NAFTA requires.

    Comments: On May 10, 2017 USTR officials said they support resuming the annual exchange of statistical data under NAFTA, given the importance of high quality and transparent statistical reporting of government procurement and the significance of the trade relationships with Canada and Mexico. The Administration is currently reassessing NAFTA. USTR will seek to ensure that the exchange of procurement statistics is considered as part of the ongoing reevaluation.
    Recommendation: The U.S. Trade Representative should, with appropriate experts in Commerce, OMB, and GSA, improve the U.S. methodology for providing federal government procurement statistics to the WTO to ensure both accurate and more timely reporting, consistent with GPA requirements--for example, by providing preliminary estimates and updated values of covered federal procurement or by using an alternative methodology that bases measures of covered government procurement on actual annual obligations, if USTR determines that such an approach is consistent with WTO obligations.

    Comments: On May 10, 2017 USTR officials the revised U.S. approach for reporting GPA-covered procurement adopted in 2015 provides significantly more accurate statistics, but at the cost of timeliness. USTR, in coordination with DOC, is working to further revise the methodology for the preparation and submission of statistics on federal procurement covered by the GPA. They expected that this revised methodology will include both preliminary estimates and updated values of covered federal procurement, per the GAO recommendation.
    Recommendation: The U.S. Trade Representative should, in consultation with appropriate experts in Commerce, OMB, and GSA, develop a methodology for reporting statistics on state governments' covered procurement to the WTO consistent with GPA requirements.

    Comments: On May 10, 2017 USTR officials said that despite noting significant challenges in preparing accurate U.S. state-level statistics on government procurement, we did not identify any concrete steps to improve the accuracy of state-level statistics. Officials have begun to research the issue and found eight states covered by the GPA currently make procurement statistics available in an on-line searchable format, but none of those states indicates the value of procurements covered by trade agreements. Nonetheless, USTR, in consultation with DOC (ITA and Census), is assessing methods for preparing more accurate state-level statistics.
    Recommendation: The U.S. Trade Representative should, in consultation with appropriate experts in Commerce, OMB, and GSA, ensure that methodologies and data sources used to prepare GPA statistical notifications are documented.

"As communicated in our December 6, 2017, letter to the Comptroller General, OPM is developing a comprehensive strategy to improve the availability of EHRI payroll data for analytics. We have started an effort to standardize payroll data elements by engaging with the payroll subject matter experts through the shared service providers. We will keep GAO informed as we make additional progress."
    Recommendation: To improve internal controls for data quality, the Director of OPM should update EHRI payroll database documentation to be consistent with current field definitions and requirements, including the Guide to Human Resources Reporting and the Guide to Data Standards, Part B.

We are also evaluating the feasibility of incorporating automated methods to validate agency data, to the extent possible. We will keep GAO informed as we make additional progress.

    Recommendation: To help the Department of Health and Human Services ensure accuracy in Part B drug payment rates, Congress should consider requiring all manufacturers of Part B drugs paid at ASP, not only those with Medicaid drug rebate agreements, to submit sales price data to CMS, and ensure that CMS has authority to request source documentation to periodically validate all such data.

    Recommendation: CMS should periodically verify the sales price data submitted by a sample of drug manufacturers by requesting source documentation from manufacturers to corroborate the reported data, either directly or by working with the HHS Office of Inspector General as necessary.

    Agency: Department of Health and Human Services: Centers for Medicare and Medicaid Services
    Status: Open

    Comments: In its comments on a draft of this report, HHS concurred with this recommendation. HHS stated that it will continue to work with the Office of Inspector General (OIG) as appropriate to collect source documentation from drug manufacturers and take action as may be warranted. HHS also stated that OIG reviews and compares the submitted average sales price (ASP) to the average manufacturer price (AMP) for Medicare Part B drugs and CMS has the authority to adjust ASP-based payment amounts when the difference between the two rates reaches a certain threshold. We do not consider this recommendation closed because CMS only collects source documentation from manufacturers under very limited circumstances (e.g., when there are obvious inconsistencies in the data submitted by manufacturers). CMS does not periodically request source documentation, such as sales invoices, from a sample of drug manufacturers to verify that the reported data reflect actual sales prices. As of August 17, 2017, CMS has not provided any additional information about actions to address this recommendation.

    Recommendation: In order to ensure complete, analyzable records regarding research grant award decisions are available for management and analysis, the Secretary of Defense should direct the Under Secretary of Defense for Acquisition, Technology and Logistics to lead the implementation of additional data collection efforts in coordination with DOD's grant-making components. These should include: (1) Retaining complete records of pre-proposal, proposal, and award data, including a record of proposal disposition, in linked electronic files to facilitate aggregate, statistical analysis of the grant-making process, including the calculation of success rates. (2) Collecting demographic, education, and career information from applicants, on a voluntary basis, that is not available to proposal reviewers but is used for analysis of success rates.

    Comments: DOD agreed with our recommendation to implement additional data collection efforts. As of August, 2017, the Basic Research Office (BRO) has drafted an implementation plan and schedule for the collection of demographic data on grant applicants and lifecycle grant data. As part of this, BRO has identified a number of issues to be addressed and resolved within DoD. One of these areas is the protection of any information collected to assess the success rates of women as Principal Investigators (PIs)/co-PIS under STEM Research grants and cooperative agreements. As a result, before BRO proceeds with its planned actions, they are working with the Office of Information Management, WHS, to ensure there are no issues related to the Privacy Act. The agency did not provide a timeline to GAO for when these actions are expected to be completed.
    Recommendation: In order to ensure complete, analyzable records regarding research grant award decisions are available for management and analysis, the Secretary of Energy should direct DOE's grant-making agencies to implement additional data collection efforts, which should include: (1) Retaining complete records of pre-proposal, proposal, and award data, including a record of proposal disposition, in linked electronic files to facilitate aggregate, statistical analysis of the grant-making process, including the calculation of success rates. (2) Collecting demographic, education, and career information from applicants, on a voluntary basis, that is not available to proposal reviewers but is used for analysis of success rates.

    Comments: DOE generally agreed with our recommendation to implement additional data collection efforts. According to DOE officials, as of September, 2017, of the four components audited at DOE, all four have taken actions toward implementing the recommendation and one component has completed its implementation. Specifically, the Office of Science began collecting investigator demographics during the second quarter of fiscal year 2015 and already retained complete records that enabled the calculation of success rates. Three additional DOE components conducted a joint feasibility study and all concur that it is feasible to collect data on demographic, education and career information of applicants. The Office of Nuclear Energy (NE) revised its approach to data collection and now retains complete grant life cycle information for each individual award, including complete records of pre-proposal, proposal, and award data in linked electronic files. NE is also changing existing data systems to input/track voluntarily submitted demographic information on Principle Investigators on applications to facilitate aggregate, statistical analysis of the grant-making process, including the calculation of success rates. The agency notes that for NE, the completion of the actions required to implement this recommendation is estimated to take up to 12 months. Advanced Research Projects Agency-Energy (ARPA-E) and the Office of Energy Efficiency and Renewable Energy (EERE) participated in the joint feasibility study regarding the collection of demographic data, but have not completed any actions to implement such data collection.
    Recommendation: As NASA begins to collect demographic data on its grant proposals and awards, the NASA Administrator should include the following key components: (1) Retain complete records of pre-proposal, proposal, and award data, including a record of proposal disposition, in linked electronic files to facilitate aggregate, statistical analysis of the grant-making process, including the calculation of success rates. (2) Collect demographic, education, and career information from applicants, on a voluntary basis, that is not available to proposal reviewers but is used for analysis of success rates.

    Agency: National Aeronautics and Space Administration
    Status: Open

    Comments: NASA agreed with our recommendation and indicated it will begin collecting basic demographic, education, and career data from its research grant applicants on a voluntary basis by the end of fiscal year 2016. In addition, NASA noted it will explore its ability to consolidate proposal and award data as part of the ongoing update to its procurement and grants management systems. As of September 2017, NASA officials reported that the notice of grant award document (form 1687) was modified to require entry of the proposal number on the form in order to capture the linkage between proposal and award. When the transition to the new contract/grant writing system (Procurement for Public Sector) occurred in June 2017, NASA began using the amended award notice. NASA states they are continuing to investigate system options for fine tuning this cross-referencing methodology. However, as of September 2017, there were no stated plans to collect or track demographic, education, or career characteristics of grant applicants in such a way as to facilitate the analysis of success rates.
    Recommendation: To comply with Title IX enforcement requirements, the Secretary of the Department of Defense, which funds STEM research at universities, should direct the Director of the Office of Diversity Management and Equal Opportunity to ensure that Title IX compliance reviews of DOD's grantees are periodically conducted.

    Comments: DOD agreed with our recommendation and noted it is in the process of revising current DOD guidance which will address its Title IX enforcement requirements. In a conversation with GAO in September 2017, a DOD official stated that the agency is in the process of formulating instructions related to both Title IX and Title VI that they believe will address the recommendation regarding Title IX enforcement. To date, these actions are not complete as they are still in the process of developing appropriate language.
    Recommendation: To comply with Title IX enforcement requirements, the Secretary of the Department of Health and Human Services, which funds STEM research at universities, should ensure that Title IX compliance reviews of NIH's grantees are periodically conducted.

    Recommendation: To help the Department of Health and Human Services better control spending and encourage efficient delivery of care, Congress should consider requiring Medicare to pay PCHs as it pays PPS teaching hospitals, or provide the Secretary with the authority to otherwise modify how Medicare pays PCHs. To generate cost savings from any reduction in outpatient payments to PCHs, Congress should also provide that all forgone outpatient payment adjustment amounts be returned to the Supplementary Medical Insurance Trust Fund.

    Comments: The 21st Century Cures Act enacted in December 2016 slightly reduces the additional payments to PCHs for outpatient services furnished on or after January 1, 2018, and returns savings to the Supplementary Medical Insurance Trust Fund. However, the law does not substantively change how PCHs are paid for outpatient services, which differs from how Medicare pays PPS teaching hospitals. In addition, as of March 1, 2017, no legislative action had been identified that changes how PCHs are paid for inpatient services, as GAO suggested in February 2015. Until Medicare pays these cancer hospitals in a way that encourages greater efficiency, Medicare remains at risk for overspending.

    Recommendation: To improve the CSA program, the Secretary of Transportation should direct the FMCSA Administrator to revise the SMS methodology to better account for limitations in drawing comparisons of safety performance information across carriers; in doing so, the Secretary of Transportation should direct the FMCSA Administrator to conduct a formal analysis that specifically identifies: (1) limitations in the data used to calculate SMS scores including variability in the carrier population and the quality and quantity of data available for carrier safety performance assessments, and (2) limitations in the resulting SMS scores including their precision, confidence, and reliability for the purposes for which they are used.

    Comments: As of October 2016, FMCSA continues to maintain that they do not agree with our methodology or conclusions. While FMCSA's position about our specific recommendation is unchanged, FMCSA noted that Section 5221 of the FAST Act directed the National Academies of Science (NAS) to conduct a safety correlation study of the CSA program, and specifically FMCSA's Safety Measurement System's (SMS) methodology. FMCSA stated that if the outcome of the NAS study results in recommendations for SMS changes, they will address those recommendations accordingly. We continue to believe this recommendation has merit and could help the agency better target FMCSA's resources to the carriers that pose the highest risk of crashing, as we demonstrate in our report. For example, we reported that FMCSA requires a minimum level of information for a carrier to receive an SMS score; however, this requirement is not strong enough to produce sufficiently reliable scores. As a result, GAO found that FMCSA identified many carriers as high risk that were not later involved in a crash, potentially causing FMCSA to miss opportunities to intervene with carriers that were involved in crashes. This new system will be known as AFMSS II and, when fully implemented, may address GAO's recommendations. Currently, BLM's actions are insufficient to close this recommendation because they have not completed the updates to AFMISS. Specifically, BLM has not completed its update of AFMSS II to cover environmental inspections. We will continue to follow up with BLM as the agency continues to take action to improve its well tracking system. As of September 2017, BLM said it intends to update AFMSS II to cover environmental issues but has not yet done so.

    Recommendation: To improve the awareness, use, and usefulness of SaferProducts.gov, the CPSC should establish and incorporate metrics to assess efforts to increase awareness and use of SaferProducts.gov.

    Comments: The Commission states that it measures overall awareness of SaferProducts.gov in a manner similar to the manner in which it measures the awareness of CPSC.gov: by the number of visits to the website. The Commission states that website visits is a reasonable proxy measure of overall awareness that is cost-effective to collect. According to the Commission, in fiscal year 2014, SaferProducts.gov had 2.4 million visits and 863,000 visitors, where visits are the number of sessions the site was hit and visitors are the count of unique IP addresses who came to the site. The Commission had previously indicated that it planned to include three questions on SaferProducts.gov in a National Awareness Survey designed to determine overall awareness of CPSC on a national level. While the Commission administered the survey, it did not include questions related to SaferProducts.gov. As of March 2017, the Commission has not taken specific steps to measure the overall awareness of SaferProducts.gov.
    Recommendation: To improve the awareness, use, and usefulness of SaferProducts.gov, the CPSC should implement cost-effective usability improvements to SaferProducts.gov, taking into account the results of any existing usability testing or any new testing CPSC may choose to conduct.

    Comments: HHS did not concur with this recommendation, noting that CMS did not believe that a payment reduction would address overutilization that occurs as a result of self-referral and that the agency's multiple procedure payment reduction policy for advanced imaging already captures efficiencies inhering in providing multiple advanced imaging services by the same physician. Further, CMS officials stated that providers in self-referring arrangements could avoid this reduction by having one provider refer an advanced imaging service while having another perform the service. Finally, CMS questioned whether implementing our recommendation would violate the Medicare statute prohibiting paying a differential by physician specialty for the same service. Our recommendation, however, refers to specific self-referral arrangements in which the same provider refers and performs an imaging service, and therefore would not be addressed by CMS's multiple procedure payment reduction policy. As noted in our report, this payment reduction would affect about 10 percent of advanced imaging services referred by self-referring providers. In addition, while CMS raised questions about whether implementing our recommendation would violate Medicare's prohibition on paying a differential by physician specialty for the same service, the agency did not indicate how it would do so as of October 2016. We continue to believe that CMS should determine and implement a payment reduction to recognize efficiencies for advanced imaging services referred and performed by the same provider even though, as of October 2016, the agency has no plans to take further action.

CMS has begun developing its appropriate use criteria program (e.g., in November 2015, CMS established criteria to identify Qualified Provider Led Entities that are responsible for developing appropriate use criteria and has since selected Qualified Provider Led Entities), but full implementation of the program will not occur until at least January 1, 2018. The Bureau concluded that extra investment of advertising in certain markets increased awareness of the Census. During 2015, the Bureau conducted research and testing on activities to support planning for the 2020 communications campaign. The Bureau based its testing, in part, on evaluation results of paid media activities the 2010 integrated communications program. In December 2015, the Census Bureau issued a draft Request for Proposal of the 2020 Integrated Communications Contract. According to the Request for Proposal, the contractor will develop a paid media plan based on tests of advertising with target audiences and complete analysis of media buys. The contractor will develop an ad tracking system to help inform decisions on allocating paid media funds for 2020. The Bureau awarded the contract in August 2016. Bureau officials have indicated action on this recommendation is due by December 31, 2017, and as of July 2017, we continue to monitor the Bureau progress in developing its approach for the 2020 Integrated Communications Program.
    Recommendation: To help improve the effectiveness of the Bureau's outreach and enumeration efforts, especially for HTC populations, should they be used again in the 2020 Census, and improve the Bureau's marketing/outreach efforts, the Secretary of Commerce should require the Under Secretary for Economic Affairs as well as the Director of the U.S. Census Bureau to develop mechanisms to increase coordination and communication between the partnership and local census office staff. According to the Request for Proposal, the Contractor will produce materials such as promotional items for partners to use in promoting awareness of the census.     Comments: In 2012, the Bureau reported on assessments of many 2010 special enumeration activities such as the Service-Based Enumeration and the Be Counted/Questionnaire Assistance Center Programs. Separately, the Bureau issued results of the 2010 Census Coverage Measurement Program that described the level of coverage of various hard-to-enumerate populations generally without attributing coverage to specific enumeration activities. In 2015, the Bureau issued its 2020 Census Operational Plan outlining design changes for enumeration activities. According to the Bureau, the changes are designed to optimize self-response and use administrative records and third party data to reduce field work. However, the Bureau had not provided details of its plans for various special enumeration activities. These activities were to be specified in new procedures coming out in 2011.

    Recommendation: To help correct undercounts, eliminate conceptual problems, and where possible, fill gaps for information on immigration flow, the Commissioner of INS should: (1) evaluate and, where feasible, improve data on flow; and (2) utilize an effective information typology (either the one put forward in table 2.1 of this report or an alternative designed by INS) to clearly distinguish different demographic concepts and to determine which statistics can fairly be compared to others.

    Comments: On September 5, 2017, GAO called the Deputy Assistant Secretary, Office of Immigration Statistics, and discussed this open recommendation. The Deputy Assistant Secretary said that in response to the February 6, 2017, e-mail and a brief personal discussion with GAO during a Migration Policy Institute conference in August 2017, he had assigned a staff member to complete work on the typology, but that the staff member was one of several who were temporarily reassigned to work in Houston as a consequence of Hurricane Harvey, and for that reason work on the typology would be delayed. He said DHS would like to have this typology completed and published before the end of 2017, but could not guarantee that, and said that it would be completed. On February 6, 2017, GAO sent an e-mail to the Deputy Assistant Secretary, Office of Immigration Statistics at DHS, which included a PDF of the typology GAO created, as well as a PDF of the published report. GAO followed up with a telephone call to the Deputy Assistant Secretary on February 24, 2017, and noted the former Director of the Office of Immigration Statistics had been working on adding some categories to the typology and planned on completing those and publishing it. The Deputy Assistant Secretary said he agreed that doing the typology and publishing it is important, and that he would be addressing it in the near future. On June 1, 2016, the Special Assistant for the Office of Policy at the Department of Homeland Security told GAO that it has initiated an examination of this recommendation to determine how it might be closed. When the typology is published and utilized, this recommendation will be closed.
