    Recommendation: To improve operational efficiencies and reduce costs related to product management and services that support commissary operations, the Secretary of Defense should direct the Chief Executive Officer of DeCA to develop a plan with objectives, goals, and time frames on how it will improve efficiency in product management, such as offering products based on store sales or customer demand.

    Comments: As of August 2017, the Defense Commissary Agency (DeCA) started to implement the Category Performance Improvement process which could help improve efficiencies by offering products based on store sales and customer demand. In addition, DeCA is also offering commissary brand items which have improved efficiencies in inventory and stocking products. By making these improvements, DeCA could improve operational efficiencies. However, DeCA is in the early stages of implementing these actions and it is unclear to what extent these efficiencies have helped reduce costs related to product management.
    Recommendation: To improve operational efficiencies and reduce costs related to product management and services that support commissary operations, the Secretary of Defense should direct the Chief Executive Officer of DeCA to conduct comprehensive cost-benefit analyses to guide decisions on implementing the most cost-effective option as stocking and custodial services contracts are renewed, and on choosing product distribution options.

    Recommendation: In order to promote effective implementation of the MAC-MO contracting strategy, the Secretary of Defense should direct the Secretary of the Navy to complete the following action: Assign responsibility to a single entity comprised of representatives from the fleet and shore-based maintenance communities, such as Surface Team 1, to perform systematic assessments of MAC-MO's implementation that include the following: (1) Review of lessons learned and identification of changes to Navy processes, including staffing, needed to support the MAC-MO strategy, (2) Evaluation of performance against anticipated cost, schedule, and quality objectives, as outlined in the MAC-MO acquisition strategy, and (3) Input and recommendations from all Navy parties that participate in the scheduling, planning, budgeting, oversight, and policy development for the repair, maintenance, and modernization of non-nuclear surface ships.

Navy has since responded that it is in the process of preparing its first biennial report on its assessment of the MAC-MO contracting strategy and this report will address the elements of our recommendation.     Recommendation: To better manage the AD/CV duty liquidation process, CBP should issue guidance directing the Antidumping and Countervailing Duty Centralization Team to (a) collect and analyze data on a regular basis to identify and address the causes of liquidations that occur contrary to the process or outside the 6-month time frame mandated by statute, (b) track progress on reducing such liquidations, and (c) report on any effects these liquidations may have on revenue.

    Comments: CBP concurred with this recommendation and said it would take steps to implement it. CBP has issued guidance requiring the collection, analysis, and reporting of AD/CV data to identify and address the causes of liquidations that occur contrary to the process or outside the 6-month time frame mandated by statute, as GAO recommended in July 2016. CBP is analyzing the results of its fiscal year 2017 self-inspection program to assess its progress on reducing such liquidations and report on the revenue effect. CBP expects to complete its analysis by Fall 2017. Systematically collecting and analyzing liquidation data on a regular basis to identify and address the causes of untimely liquidations and tracking and reporting on progress toward reducing such liquidations could help CBP reduce revenue loss.
    Recommendation: To improve risk management in the collection of AD/CV duties and to identify new or changing risks, CBP should regularly conduct a comprehensive risk analysis that assesses both the likelihood and the significance of risk factors related to AD/CV duty collection. For example, CBP could construct statistical models that explore the associations between potential risk factors and both the probability of nonpayment and the size of nonpayment when it occurs.

    Comments: CBP concurred with this recommendation and said it would take steps to implement it. As of September 2017, CBP had not regularly conducted a risk analysis that assesses both the likelihood and significance of risk factors related to AD/CV duty collection, as GAO recommended in July 2016. However, CBP was in the process of developing a model to enable it to conduct such a risk analysis on a regular basis. CBP expects to test the model by Fall 2017; however, CBP officials said that full implementation of the model will not take place until the end of fiscal year 2018 due to the complexity of the project. CBP officials noted that they are working to hire additional staff to dedicate to model development; acquire a dedicated server for processing data to regularly update the models; and identify other CBP programs that would benefit from risk models similar to the ones they are developing for AD/CV duties. Regularly conducting a comprehensive risk analysis of factors related to AD/CV duty non-collection could enhance CBP's capacity to collect additional revenue. For example, it could result in the identification of new factors generating a requirement for an importer to provide additional security in the form of bonds as part of an enhanced bonding requirement.
    Recommendation: To improve risk management in the collection of AD/CV duties, CBP should, consistent with U.S. law and international obligations, take steps to use its data and risk assessment strategically to mitigate AD/CV duty nonpayment, such as by using predictive risk analysis to identify entries that pose heightened risk and taking appropriate action to mitigate the risk.

    Comments: CBP concurred with this recommendation and said it would take steps to implement it. As of September 2017, CBP was in the process of developing a risk analysis model to use in mitigating AD/CV duty nonpayment, as GAO recommended in July 2016. The model will use predictive risk analysis to identify entries that pose a heightened risk of nonpayment. CBP has contacted the Customs Surety Association and the Commercial Customs Operations Advisory Committee to discuss bonding options to help mitigate the risk of nonpayment. Developing a risk analysis model to use in mitigating AD/CV duty nonpayment could enhance CBP's capacity to collect additional revenue. For example, it could be used to identify entries from importers requiring additional security in the form of bonds as part of an enhanced bonding requirement.

    Comments: In providing comments on this report, the agency concurred with this recommendation and stated that the department will issue guidance to help ensure that components make reasonable efforts to analyze component-level purchase card spend patterns to identify areas of potential savings. In September 2016, DOD issued guidance asking its components to analyze purchase card spend for potential cost savings and to consider broader application of cost savings opportunities across the department. We will continue to follow up with DOD to determine what steps have been taken to communicate findings.
    Recommendation: To help identify opportunities for cost savings, the Secretary of the Department of Energy should take reasonable steps to regularly analyze agency-wide purchase card spend patterns to identify areas such as high-use vendors or frequently purchased commodities for further analysis.

The department is also working with industry partners to increase the level of shared data for purchase card transactions and will develop a plan to communicate these data across the agency to support information sharing and increases strategic sourcing opportunities.

    Comments: The department partially concurred with this recommendation, agreeing that it would be useful to perform analysis of purchase card spend patterns to identify opportunities for savings. However, rather than issue guidance, it will encourage its bureau charge card leads to use available tools to extract and share data with buyers and program managers. The department will also encourage bureau program and acquisition managers to share spend data across regional boundaries to identify potential opportunities to negotiate lower costs for commonly used items.
    Recommendation: To ensure that good practices are shared within agencies, the Secretaries of Defense, Veterans Affairs, the Interior, Homeland Security, and Energy, and the Environmental Protection Agency should develop guidance that encourages local officials to examine purchase card spend patterns to identify opportunities to obtain savings and to share information on such efforts.     Comments: The department concurred with our recommendation and plans to develop guidance and implement strategic sourcing for all purchasing requirements to include purchase cards. Additionally the department will update purchase card policy to encourage agency officials to analyze spend patterns to identify opportunities to obtain savings and share information on these efforts. Further, the agency has developed a quarterly report to identify the top merchants receiving payment through the purchase card program in order to assist officials in identifying opportunities for strategic sourcing.

Consistent with our recommendation, DOD reevaluated its methodology for establishing the fiscal year 2017 standard price and documented parts of the methodology it used. Specifically, DOD detailed the various options it considered, the reasons why it chose the methodology it used, and the calculations it used to arrive at its estimated standard price in an internal Office of the Under Secretary of Defense (Comptroller) memorandum. However, DOD has not documented a process for establishing the standard price in three areas. First, DOD has not documented a formalized process that describes the steps it will take on an annual basis to determine the standard price for future fiscal years. Second, documentation detailing the options DOD considered and the rationale behind the methodology it chose is not available to Congress and its fuel customers. Third, DOD has not document the formal review and approval of the new methodology by senior Comptroller officials. The DOD Comptroller official who is responsible for managing the bulk fuel program stated that the department does not have a similar formal process for determining rates for other commodities and working capital funds. Therefore, the official stated that DOD does not want to make the bulk fuel standard price determination unique and apart from these other commodities. Because of concerns with the quality and transparency of information available to Congressional decision makers and department fuel customers concerning the methodology selected each year and its application to relevant data used in estimating fuel rate prices for the next fiscal year, the Senate Armed Services Committee directed DOD to submit detailed guidance to the congressional defense committees no later than February 1, 2017 that, among other aspects, requires documentation of the rationale for using one methodology over another for estimating the next fiscal year's fuel rate price, to include the limitations and assumptions of underlying data and establishing a timeline for developing annual estimated fuel rate prices for the next fiscal year. Documenting DOD's assumptions would provide greater transparency and clarify for fuel customers and decision makers regarding the process DOD uses to set the standard price.

    Recommendation: To better protect plan sponsors and participants who use managed account services, the Secretary of Labor should direct the Assistant Secretary for the Employee Benefits Security Administration (EBSA) to review provider practices related to additional managed account services offered to participants in or near retirement, with the aim of determining whether conflicts of interest exist and, if it determines it is necessary, taking the appropriate action to remedy the issue.

    Comments: In 2014, DOL agreed to include these practices in its current review of investment advice conflicts of interest, noting that such conflicts continue to be a concern. In April 2015, a proposed regulation was published in the Federal Register on the definition of a "fiduciary" of an employee benefit plan under the Employee Retirement Income Security Act of 1974 (ERISA) as a result of giving investment advice to a plan or its participants or beneficiaries. The proposal would widen the array of advice relationships under which someone would be considered a fiduciary under ERISA more broadly than existing regulations. This would increase consumer protection for plan sponsors, fiduciaries, participants, beneficiaries and IRA owners. An initial comment period closed on July 21, 2015. DOL held a public hearing on August 10-13, 2015, and reopened the comment period until September 24. GAO will monitor the progress of this proposed rule.
    Recommendation: To better protect plan sponsors and participants who use managed account services, the Secretary of Labor should direct the Assistant Secretary for the EBSA to consider the fiduciary status of managed account providers when they offer services on an opt-in basis and, if necessary, make regulatory changes or provide guidance to address any issues.

However, GAO also agrees that DOL should examine the scope of its existing authority in considering how it might implement this recommendation.
    Recommendation: To help sponsors and participants more effectively assess the performance of managed accounts, the Secretary of Labor should direct the Assistant Secretary for EBSA to amend participant disclosure regulations to require that sponsors furnish standardized performance and benchmarking information to participants. To accomplish this, EBSA could promulgate regulations that would require sponsors who offer managed account services to provide their participants with standardized performance and benchmarking information on managed accounts. For example, sponsors could periodically furnish each managed account participant with the aggregate performance of participants' managed account portfolios and returns for broad-based securities market indexes and applicable customized benchmarks, based on those benchmarks provided for the plan's designated investment alternatives.

DOL also consulted with the ERISA Advisory Council on ways it could assist DOL in this area. The Council developed and submitted to DOL tips, principals, and samples for plan sponsors to consider when communicating with participants. However, DOL has not taken additional steps in this area and continues to cite its other regulatory and guidance priorities as taking precedence.
    Recommendation: As DOL continues to review regulatory barriers to lifetime income options for 401(k) plan participants it should consider other countries' approaches to plans offering annuities, such as their reliance on existing solvency requirements and insurance industry standards to provide assurances rather than place responsibility on plan sponsors to make an assessment of an annuity provider's financial stability. As DOL considers the approaches of other countries and continues to work with the National Association of Insurance Commissioners, which facilitates interactions between insurance companies and state insurance regulators, DOL may wish to consult with the Federal Insurance Office, which coordinates federal efforts on prudential aspects of international insurance matters.

    Recommendation: To improve DOE's management and oversight of the WFO program, the Secretary of Energy should require laboratories to establish and follow written procedures for developing WFO project budgets and for charging costs to WFO projects.

    Comments: According to DOE, the Chief Financial Officer will address this recommendation as part of the revisions to DOE Order 520.1A. As of March 2017, DOE anticipates that the updated order will be completed in the first quarter of fiscal year 2018.
    Recommendation: To improve DOE's management and oversight of the WFO program, the Secretary of Energy should ensure that annual summary reports of WFO activities are prepared so that data on those activities are readily available for those who need this information.

    Comments: On December 5, 2016, DOE issued revised order 481.1D, Strategic Partnership Projects (SPP) [Formerly Known as Work for Others (Non-Department of Energy Funded Work)] and has removed the requirement to issue annual summary reports of Work for Others activities. Instead, the revised order states that reports can be prepared on an "as needed" basis.
    Recommendation: To improve DOE's management and oversight of the WFO program, the Secretary of Energy should establish performance measures that incorporate key attributes of successful performance measures and that address the objectives of the WFO program.

    Comments: On December 5, 2016, DOE issued revised order 481.1D Strategic Partnership Projects (SPP)[Formerly Known as Work for Others (Non-Department of Energy Funded Work)]. DOE states that this order addresses performance measures and that the corrective action is closed. Although the order directs DOE Field Office Managers to "establish performance measures to assess the effectiveness of the procedures for SPP review, acceptance, authorization and monitoring consistent with NNSA policies and procedures", it does not further identify specific performance measures that address the objectives of the SPP program as indicated in the order.

    Recommendation: Because USPS faces a deteriorating financial situation, and to help ensure that future promotions generate net revenue for USPS, the Chairman of the PRC should direct staff to evaluate USPS's data collection and analysis plans for USPS's proposed mail promotions and discuss these evaluations in the PRC decisions for those mail promotions.

    Comments: The Postal Regulatory Commission (PRC) said that it agreed with our recommendation. PRC has also noted the U.S. Postal Service (USPS) is not required by statute to collect data on promotions and provide it to PRC. Based on the information it received, PRC approved USPS's Calendar Year 2017 promotions. However, USPS did not provide PRC with information regarding its plans to estimate the net financial results of the proposed promotions, as we recommended. As no such information was received, no evaluation of these plans was prepared by PRC, and this recommendation remains open.

    Recommendation: As HHS implements its current and forthcoming efforts to make transparent price information available to consumers, HHS should determine the feasibility of making estimates of complete costs of health care services available to consumers through any of these efforts.

    Comments: In May 2013, CMS released average inpatient hospital charge information for more than 3,000 hospitals that receive Medicare Inpatient Prospective Payment System payments for the 100 most frequently billed discharges using DRGs from FY2011 and corresponding average Medicare payments. Shortly thereafter CMS also released outpatient charges. In April 2014, CMS also released data on payments to physicians under Medicare part B. This represents an effort to provide price transparency, although these are not complete cost estimates according to our definition in this report. As of September 2015, we are awaiting an update from HHS on the status of this recommendation. We will update the status of this recommendation when we receive additional information.

Therefore, the Secretary of HHS should instruct the administrator of HRSA to finalize new, more specific guidance on the definition of a 340B patient.

    Recommendation: PPACA contained several important program integrity provisions for the 340B program, and additional steps can also ensure appropriate use of the program. Therefore, the Secretary of HHS should instruct the administrator of HRSA to issue guidance to further specify the criteria that hospitals that are not publicly owned or operated must meet to be eligible for the 340B program.

    Recommendation: To improve the transparency of information on airline-imposed fees and government-imposed taxes and fees for consumers and improve airlines' reporting of fee revenues to the Department of Transportation, the Secretary of Transportation should improve the disclosure of baggage fees and policies to passengers, in accordance with DOT guidance, by requiring that U.S. airlines and foreign airlines that fly within or to or from the United States disclose baggage fees and policies along with fare information such that this information can be consistently disclosed across all distribution channels used by the airline.

    Recommendation: To improve the transparency of information on airline-imposed fees and government-imposed taxes and fees for consumers and improve airlines' reporting of fee revenues to the Department of Transportation, the Secretary of Transportation should require U.S. passenger airlines to report to DOT all optional fees paid by passengers related to their trip in a separate account, exclusive of baggage fees and reservation change and cancellation fees.

    Comments: A DOT rulemaking (RIN-2105-AE56: Transparency of Airline Ancillary Service Fees) is ongoing and could address this recommendation. As of June 2017, the final rule is expected to be published in late 2017/early 2018.
    Recommendation: If Congress determines that the benefit of added revenue to the Airport and Airway Trust Fund from taxation of optional airline service fees, such as baggage fees, is of importance, then it may wish to consider amending the Internal Revenue Code to make mandatory the taxation of certain or all airline imposed fees and to require that the revenue be deposited in the Airport and Airway Trust Fund.

    Comments: As of June 2017, Congress has not yet taken action regarding this matter. While amendments have been offered to change the tax treatment of airline fees, none of these amendments have been passed into law. We will continue to monitor this matter and will provide updated information.
