    Recommendation: To improve NRC's ability to strategically manage the size and composition of its workforce and respond to changes in the nuclear industry, the Chairman of the Nuclear Regulatory Commission should set agencywide goals, which could be ranges, for overall workforce size and skills composition that extend beyond the 2-year budget cycle.

    Comments: In comments on a draft of the report, NRC generally agreed with the recommendation. In its June 2017 letter on plans for implementing the recommendation, NRC stated that it will implement a new activity to project workload over a 5-year time period. The resulting workload projections will be used to identify core staff positions needed to perform the work. NRC expects that this effort will facilitate setting agency goals for FTE and appropriate agency size beyond the current 2 year budget cycle and will support the agency's effort to enhance its human capital practices. We will review NRC's actions, once completed, to determine whether they meet the intent of this recommendation.

Skills and competencies for each of the core positions will be identified and catalogued, allowing employees and supervisors to search for specific competencies needed to support work throughout the agency. We will review NRC's actions, once completed, to determine whether they meet the intent of this recommendation.
    Recommendation: To improve NRC's ability to strategically manage the size and composition of its workforce and respond to changes in the nuclear industry, the Chairman of the Nuclear Regulatory Commission should consistently train managers and supervisors in strategic human capital management and assessing employee skillsets.

    Comments: In comments on a draft of the report, NRC generally agreed with the recommendation. In its June 2017 letter on plans for implementing the recommendation, NRC stated that it developed a Supervisor Development Program SharePoint site to centrally house information pertinent to management activities and required training. NRC will provide information on the agency's strategic workforce planning process as it evolves via this site. Additionally, NRC plans to incorporate the strategic workforce planning process and concepts into existing management training that will be delivered in-person and available on-line. We will review NRC's actions, once completed, to determine whether they meet the intent of this recommendation.

    Recommendation: To improve the awareness of how risk-significant radioactive sources are transported within the United States and to better determine whether Nuclear Regulatory Commission (NRC) is meeting its goal of providing reasonable assurance for preventing the theft or diversion of these dangerous materials, the Chairman of NRC should take actions to collect information from licensees on the number of shipments and mode of transport for such sources--for example, by identifying the extent to which an existing NRC database (e.g., the National Source Tracking System) may be used to capture this information.

    Comments: In its 60-day response letter from NRC to GAO, NRC repeated its position on this recommendation as stated in its formal agency response that was included as appendix III in the report. In both cases, NRC states that it disagrees with this recommendation. NRC disagrees that the specific number of shipments by mode of transport is always needed. NRC explained that existing information collection requirements already exist for category 1 quantities and that it had previously determined that collection of shipment information for category 2 quantities was not necessary. NRC also stated that NSTS would not be the appropriate database to capture shipment information; it is not designed to capture real-time information. In addition, NRC does not consider the proposed collection activity to be of sufficient benefit to justify the additional cost of capturing the information. Therefore, NRC does not believe that adopting this recommendation would result in significant improvements to safety. Despite its disagreement with this recommendation, we will continue to monitor whether NRC takes any actions that would result in addressing the concern GAO raised.
    Recommendation: To further enhance the security of radioactive sources during ground transport, the Chairman of NRC, in consultation with the Secretary of Transportation and the Secretary of Homeland Security, should identify an approach to verify that motor carriers are meeting NRC's Part 37 security requirements applicable to transportation, for example by having DOT inspectors verify compliance with NRC Part 37 security requirements during their on-site investigations.

    Comments: As noted in the NRC comments on the GAO report, the NRC agrees in general with the second recommendation to explore with Federal partners an approach to verify that motor carriers meet 10 CFR Part 37 transportation security requirements. The NRC commits to exploring how the respective agencies can verify that motor carriers are meeting the NRC's applicable Part 37 transportation security requirements. This recommendation will remain open until NRC presents evidence that it has acted on it.

    Recommendation: To enhance the transparency and timeliness of NRC's fee-setting process, the Chairman of the Nuclear Regulatory Commission should direct NRC staff to clearly present information in NRC's proposed fee rule, final fee rule, and fee work papers, by defining and consistently using key terms, providing complete calculations for how fees are determined, and ensuring the accuracy of the fee rules and work papers, so that stakeholders can understand fee calculations and provide substantive comments to the agency on them.

    Comments: According to NRC, it has provided more detailed explanations and calculations in its fiscal year 2017 proposed fee rule. The agency plans to propose codifying some of these changes in Title 10 of the Code of Federal Regulations Part 170 during its fiscal year 2018 fee rulemaking. We will review NRC's changes after it has codified them in the Code of Federal Regulations and will update the status of this recommendation at that time.
    Recommendation: To enhance the transparency and timeliness of NRC's fee-setting process, the Chairman of the Nuclear Regulatory Commission should direct NRC staff to develop objective, measurable, and quantifiable performance goals and measures that enable NRC to assess the extent to which its efforts to improve transparency and timeliness are successful and implement a plan and schedule for comparing results with the established performance goals.

    Comments: NRC convened a steering committee to provide leadership for implementing its efforts to improve transparency and timeliness of its fee-setting process.     Recommendation: Because some quantities of radioactive materials are potentially dangerous to human health if not properly handled, NRC should take action to better track and secure these materials and verify the legitimacy of the licenses for those who seek to possess them. Specifically, the NRC should take the steps needed to include category 3 sources in the National Source Tracking System and add agreement state category 3 licenses to the Web-based Licensing System as quickly as reasonably possible.

Among other things, this re-evaluation will consider GAO's recommendations. This re-evaluation is due to be submitted to the Commission by August 2017.
    Recommendation: Because some quantities of radioactive materials are potentially dangerous to human health if not properly handled, NRC should take action to better track and secure these materials and verify the legitimacy of the licenses for those who seek to possess them. Specifically, the NRC should at least until such time that category 3 licenses can be verified using the License Verification System, require that transferors of category 3 quantities of radioactive materials confirm the validity of a would-be purchaser's radioactive materials license with the appropriate regulatory authority before transferring any category 3 quantities of licensed materials.

    Comments: In October 2016, NRC issued a Staff Requirements Memorandum (SRM) "Proposed Staff Re-Evaluation of Category 3 Source Accountability," (SRM-COMJMB-16-0001) and directed NRC staff to take specific actions to evaluate whether it is necessary to revise NRC regulations or processes governing source protection and accountability for Category 3 sources. Among other things, this re-evaluation will consider GAO's recommendations. This re-evaluation is due to be submitted to the Commission by August 2017. The License Verification and Transfer of Category 3 Sources Working Group (LVWG) evaluated this recommendation, and its analysis will be considered by the Category 3 Source Security and Accountability Working Group in the development of the notation vote paper that will be submitted to the Commission in August 2017.
    Recommendation: Because some quantities of radioactive materials are potentially dangerous to human health if not properly handled, NRC should take action to better track and secure these materials and verify the legitimacy of the licenses for those who seek to possess them. Specifically, the NRC should, as part of the ongoing efforts of NRC working groups meeting to develop enhancements to the prelicensing requirements for category 3 licenses, consider requiring that an on-site security review be conducted for all unknown applicants of category 3 licenses to verify that each applicant is prepared to implement the required security measures before taking possession of licensed radioactive materials.

    Comments: NRC concurred with our recommendation. NRC supplied documents regarding its cybersecurity assessment process, but has not yet provided evidence of re-evaluating assessments to ensure that technical controls were comprehensively tested.
    Recommendation: To improve agency information security programs, the Chairman of the Nuclear Regulatory Commission should update remedial action plans for selected systems, to include responsible organization, estimated funding, funding source, and scheduled completion dates.

    Comments: NRC concurred with our recommendation. The agency provided evidence that it is including the responsible organization and scheduled completion dates in its plans of action and milestones (POA&Ms). While the estimated funding and source of funding do not appear in the POA&Ms, the agency has indicated that this data is available elsewhere. We are following up with NRC to verify this information.
    Recommendation: To improve agency information security programs, the Chairman of the Nuclear Regulatory Commission should update the standard that addresses continuous monitoring to include metrics and ongoing status monitoring.

    Comments: The Nuclear Regulatory Commission (NRC) agreed with our recommendation, and has taken initial steps to implement it. In May 2016, NRC stated in correspondence to GAO that it was pursuing development of a hybrid data center that will allow many data center functions to be performed in the cloud, allowing for more optimization, including the ability to better meet optimization targets (including those related to both cost savings and optimization) established by the Office of Management and Budget (OMB) through the Data Center Optimization Initiative. As of July 2017, NRC reports on OMB's IT Dashboard that it meets one (server virtualization) of the five data center optimization metric targets that OMB currently requires agencies to report against. However, the agency reports that it does not meet the remaining four targets (related to server utilization and monitoring, energy metering, server virtualization, data center facility space, and power usage efficiency). We will continue to monitor and evaluate the agency's progress in implementing this recommendation.

    Recommendation: To ensure that the security of radiological sources at industrial facilities is reasonably assured, the Chairman of the Nuclear Regulatory Commission should conduct an assessment of the T&R process--by which licensees approve employees for unescorted access--to determine if it provides reasonable assurance against insider threats, including (1) determining why criminal history information concerning convictions for terroristic threats was not provided to a licensee during the T&R process to establish if this represents an isolated case or a systemic weakness in the T&R process; and (2) revising, to the extent permitted by law, the T&R process to provide specific guidance to licensees on how to review a employee's background. NRC should also consider whether certain criminal convictions or other indicators should disqualify an employee from T&R or trigger a greater role for NRC.

    Comments: On December 14, 2016, the NRC provided Congress with a report detailing its review of the effectiveness of the requirements in 10 CFR Part 37 to determine whether any additional security measures, guidance updates, rulemaking changes, or licensee outreach efforts are appropriate. The completion of the 10 CFR Part 37 program review included insights into the effectiveness of the T&R process. Specifically, the review generated recommendations for enhancements in the area of T&R, including, among other things, increased controls for protection of information related to individuals having access to Category 1 and 2 quantities of radioactive materials; improved guidance related to information individuals must disclose when applying for unescorted access; development of sample forms or templates for use in T&R evaluations; and improved coordination efforts with the FBI to share potential terrorist threat information involving individuals seeking approval for new or continued unescorted access to Category 1 and 2 quantities of radioactive materials. However, certain aspects of the NRC staff's assessment of the T&R process remain ongoing. Specifically, on November 25, 2016, the staff closed Temporary Instruction (TI) 2800/042, "Evaluation of Trustworthiness and Reliability Determinations," and is using the information gained from the TI to consider additional enhancements to the T&R process. As part of this continuing effort, the NRC will evaluate the potential use of disqualifying criteria in making T&R determinations and the incorporation of additional insider mitigation program features, such as requiring the self-reporting of legal actions, into the T&R process to which the individual has been subject. The NRC expects this evaluation to be completed in December 2017.

    Recommendation: To ensure the effective management of software licenses, the Chairman of the Nuclear Regulatory Commission should employ a centralized software license management approach that is coordinated and integrated with key personnel for the majority of agency software license spending and/or enterprise-wide licenses.

    Comments: The Nuclear Regulatory Commission (NRC) has taken steps to implement this recommendation. For example, in March 2017, NRC reported that the agency's Software Manager is in the process of developing the NRC Software Management Centralization Plan to meet NRC's business needs and to ensure compliance with applicable Federal mandates and guidelines, including those from the Office of Management and Budget, the Federal Information Technology Acquisition Reform Act, the Federal Information Security Management Act, and from the National Institute of Standards and Technology. We plan to follow up with the agency to obtain supporting documents and continue to monitor its progress in implementing this recommendation.
    Recommendation: To ensure the effective management of software licenses, the Chairman of the Nuclear Regulatory Commission should establish a comprehensive inventory of software licenses using automated tools for the majority of agency software license spending and/or enterprise-wide licenses.

    Comments: In March 2017, the Nuclear Regulatory Commission (NRC) reported that the agency will analyze agency-wide software license data after it deploys an automated tool.     Recommendation: To ensure the effective management of software licenses, the Chairman of the Nuclear Regulatory Commission should provide software license management training to appropriate agency personnel addressing contract terms and conditions, negotiations, laws and regulations, acquisition, security planning, and configuration management.

    Comments: In March 2017, the Nuclear Regulatory Commission (NRC) reported that the agency plans to provide software license management training to all key personnel. NRC also reported that its software training is currently being developed by the Office of Management and Budget, the Federal Acquisition Institute and the Defense Acquisition University.     Recommendation: To better inform efforts for nuclear power plant emergency preparedness and planning, NRC Commissioners should obtain information on public awareness of radiological emergency preparedness for communities outside the 10-mile emergency planning zone and the likely response of those communities in the event of a radiological incident at a nuclear facility and consider how these results may affect estimates for shadow evacuations outside the zone.

    Recommendation: To further strengthen NRC's oversight of decommissioning funding assurance, the NRC Commissioners should better ensure that licensees are providing reasonable assurance that they will have the necessary funds and improve the consistency of information the agency collects by continuing these reviews of fund balances in a way that is most efficient and effective for the agency.

    Comments: In May 2016, an NRC official told us that agency staff are currently in the process of revising the agency guidance document, "Procedures for NRC's Independent Analysis of Decommissioning Funding Assurance for Operating Nuclear Power Reactors" (LIC-205) to incorporate factors to be considered by the agency as a basis of when to perform an as-needed spot-check. According to the official, agency staff reviewed the performance of the spot-check program between the period of April 2008 and June 2014, and, in June 2015, recommended that the agency use the spot-check program only on an as-needed basis. It is possible that this staff recommendation may lead to the agency conducting reviews of fund balances in an efficient and effective way. However, NRC might also choose to end the spot check program as the agency has done in the past. As of May 2017, the revised guidance was not available. We will review the revised guidance after it becomes available.
