    Recommendation: To ensure that DOE's control activities continue to be relevant and effective for managing supply chain risk, the Secretary should direct the Under Secretary for Nuclear Security, as the Administrator of the NNSA, to work with the Office of Intelligence and Counterintelligence and other DOE organizations, as appropriate, to assess the circumstances that might warrant using the enhanced procurement authority, and (1) if this assessment identifies circumstances that might warrant using the authority, the Secretary should direct the Under Secretary for Nuclear Security to work with other DOE organizations, as appropriate, to establish processes for using it and examine whether adequate resources are in place to support those processes, and (2) communicate the results of this assessment to the relevant congressional committees for their use in determining whether to extend the authority past its current termination date.

    Comments: In an October 7, 2016, letter the Under Secretary for Nuclear Security and Administrator of the National Nuclear Security Administration (NNSA) said he agreed with GAO's recommendation to assess situations that might warrant the use of the enhanced procurement authority and, should specific circumstances be identified for use of the authority, NNSA would develop a process for its use. The assessment would include an examination of resources to support use of the authority. NNSA would work with other Department of Energy organizations as appropriate in conducting the assessment. The results would be shared with relevant congressional committees, as GAO recommended. NNSA had anticipated completion of the assessment by March 2017, but on June 1, 2017, NNSA officials told us they anticipated the completion date would be September 30, 2017.

    Recommendation: To strengthen acquisition planning for M&O contract acquisitions, the Secretary of Energy should direct the Office of Acquisition Management, Office of Policy to require that acquisition planning documents for M&O contracts discuss alternatives beyond extending the M&O contract or conducting a competition for essentially the same scope of work.

    Comments: In November 2016, DOE officials stated that the Office of Acquisition Management will amend existing or issue new policy or guidance, as appropriate, with an estimated completion date of January 2017.
    Recommendation: To strengthen acquisition planning for M&O contract acquisitions, the Secretary of Energy should direct the Office of Acquisition Management, Office of Policy to establish a process to periodically analyze DOE's experience with alternatives to the single M&O contract approach to identify and apply lessons learned during acquisition planning for M&O contracts.

    Recommendation: To enhance the usefulness of NNSA's future reports to Congress describing the costs and benefits of its competition of M&O contracts under the requirements contained in Section 3121 of the National Defense Authorization Act for fiscal year 2013, as amended, the NNSA Administrator should take steps to ensure that future reports reflect DOE's information quality guidelines, federal cost accounting standards, and GAO's best practices guidance relevant to the clear and complete presentation of information on each of the required topics. In particular, future reports should clearly and completely describe costs and benefits, including the agency's expectations, as well as the associated analysis, assumptions, information sources, and key limitations and uncertainties about costs and benefits described. The description of uncertainties should include key excluded or unspecified costs and benefits, such as those that are anticipated but not fully known at the time of report writing.

    Comments: NNSA recently awarded an M&O contract for Sandia NL. NNSA will have to produce a report on the costs and benefits of its competition, which will need to be delivered in early spring, 2017. Upon delivery to Congress, GAO will be able to assess whether NNSA fulfilled this recommendation.

    Recommendation: To improve DOE's management and oversight of the WFO program, the Secretary of Energy should require laboratories to establish and follow written procedures for developing WFO project budgets and for charging costs to WFO projects.

    Comments: According to DOE, the Chief Financial Officer will address this recommendation as part of the revisions to DOE Order 520.1A. As of March 2017, DOE anticipates that the updated order will be completed in the first quarter of fiscal year 2018.
    Recommendation: To improve DOE's management and oversight of the WFO program, the Secretary of Energy should ensure that annual summary reports of WFO activities are prepared so that data on those activities are readily available for those who need this information.

    Comments: On December 5, 2016, DOE issued revised order 481.1D, Strategic Partnership Projects (SPP) [Formerly Known as Work for Others (Non-Department of Energy Funded Work)] and has removed the requirement to issue annual summary reports of Work for Others activities. Instead, the revised order states that reports can be prepared on an "as needed" basis.
    Recommendation: To improve DOE's management and oversight of the WFO program, the Secretary of Energy should establish performance measures that incorporate key attributes of successful performance measures and that address the objectives of the WFO program.

    Comments: On December 5, 2016, DOE issued revised order 481.1D Strategic Partnership Projects (SPP)[Formerly Known as Work for Others (Non-Department of Energy Funded Work)]. DOE states that this order addresses performance measures and that the corrective action is closed. Although the order directs DOE Field Office Managers to "establish performance measures to assess the effectiveness of the procedures for SPP review, acceptance, authorization and monitoring consistent with NNSA policies and procedures", it does not further identify specific performance measures that address the objectives of the SPP program as indicated in the order.

    Recommendation: To better focus agencies' efforts to manage the risks related to professional and management support service contracts, the Director of OMB, through the Office of Federal Procurement Policy (OFPP), should establish a near-term deadline for agencies to develop internal procedures required by OFPP Policy Letter 11-01, including for services that closely support inherently governmental functions.

    Comments: In providing comments on our report, OFPP generally agreed with this recommendation. During follow-up discussions, OFPP agreed to provide additional information to confirm the actions they have taken to address the recommendation. However, we have yet to receive this information. We will continue to follow this recommendation and provide updated information when available.
    Recommendation: To ensure that the risks of professional and management support service contracts are more fully considered and addressed, the Director of OMB, through the Office of Federal Procurement Policy, should include contracts coded in the Federal Procurement Data System - Next Generation (FPDS-NG) as Other Professional Services and Other Management Support Services in the cost savings initiative for management support services and planned service contract inventory guidance to agencies for conducting analysis of special interest functions.

    Comments: In providing comments on our report, OFPP generally agreed with this recommendation. We have had discussions with OFPP and they agreed to provide additional information on the actions taken to address the recommendation. However, we have yet to receive this information.     Recommendation: To better inform acquisition decisions, assist DOD personnel in performing their management oversight responsibilities, and improve DOD's surveillance of services contracts, the Secretary of Defense should require before the award of any contract or issuance of task order for services closely supporting inherently governmental functions that program and contracting officials consider and document their assessment of the unique risks of these services and the steps that have been taken to mitigate such risks.

    Comments: In providing comments on this report, DOD concurred with this recommendation and had initiated actions to provide additional guidance. As of September 2017, however, DOD has not provided additional guidance to its contracting officers on considering, documenting, and mitigating the risks associated when obtaining services closely associated with inherently governmental functions.
    Recommendation: To better inform acquisition decisions, assist DOD personnel in performing their management oversight responsibilities, and improve DOD's surveillance of services contracts, the Secretary of Defense should develop guidance to identify approaches that DOD should take to enhance management oversight when contractors provide services that closely support inherently governmental functions.
