    Recommendation: To strengthen CBP's ability to assess and respond to compliance risks across the FTZ program, the Commissioner of CBP should centrally compile information from FTZ compliance reviews and associated enforcement actions so that standardized data are available for assessing compliance and internal control risks across the FTZ program.

    Recommendation: To strengthen CBP's trade enforcement efforts, the Commissioner of CBP should direct the Office of Trade to include performance targets, when applicable, in addition to performance measures in its Priority Trade Issue strategic and annual plans.

    Comments: As of September 2017, CBP indicated that CBP's Office of Trade has been performing biweekly reviews of current performance measure results and had scheduled a management planning meeting to closeout FY 2017. CBP indicated that these efforts will help establish the performance target baselines for FY 2018. CBP indicated that it plans to establish the FY 2018 priorities and Priority Trade Issue strategic and annual plans, but as of September 2017 has not provided timeframes for project completion.
    Recommendation: To strengthen CBP's trade enforcement efforts, the Commissioner of CBP should direct the Office of Trade and the Office of Field Operations to develop a long-term hiring plan that articulates how CBP will reach its staffing targets for trade positions set in the Homeland Security Act and the agency's resource optimization model.

    Comments: As of September 2017, CBP indicated that, in order to develop a long-term hiring plan, CBP's Office of Trade (OT), Office of Field Operations (OFO), and Human Resources Management (HRM) established a working group of key stakeholders to define the hiring challenges related to the trade positions. CBP identified the key stakeholders for the working group and was planning its first meeting for the working group. In the interim, CBP indicated that it was actively addressing trade hiring gaps through a variety of mechanisms that includes building recruiting partnerships with universities as well as closely tracking and monitoring the hiring of import specialists from initial announcement through entrance on duty.

    Recommendation: To improve the quality and transparency of statistical reporting of international government procurement by GPA and U.S. FTA parties to fulfill their commitments under these agreements, the U.S. Trade Representative should prepare and submit a proposal to the WTO GPA working group on statistical reporting established by the Committee on Government Procurement that aims to improve the quality of statistical reporting by WTO parties to address the weaknesses we identified.

    Comments: On May 10, 2017 USTR officials said the United States has long struggled with the challenges associated with comparing statistics produced by the United States with statistics provided by U.S. trading partners where there are inconsistencies in statistical reporting. To respond to this known challenge, USTR led an effort to establish a work program on statistical reporting during the revised GPA negotiations. The WTO GPA statistical work program calls for parties to make recommendation on four issues: 1) whether the GPA Parties should adopt a common method for collection of statistics; 2) whether the GPA Parties are able to standardize the classifications in the statistical data reported to the GPA Committee; 3) means for facilitating the collection of country of origin of goods and services covered by the agreements; and 4) other technical issues in government procurement data reporting raised by any GPA Party. In 2017, USTR assumed the chair of the work program as part of its effort to ensure that the GPA Parties continue to make progress in their work on these recommendations. On April 27, 2017, USTR tabled a proposal that identifies outstanding issues preventing GPA Parties from improving the quality of statistical reporting. GPA Parties have agreed to discuss these issues at another work program meeting chaired by USTR in June 2017.
    Recommendation: To improve the quality and transparency of statistical reporting of international government procurement by GPA and U.S. FTA parties to fulfill their commitments under these agreements, the U.S. Trade Representative should resume the annual exchange of statistical data on covered government procurement with the other NAFTA parties as NAFTA requires.

    Comments: On May 10, 2017 USTR officials said they support resuming the annual exchange of statistical data under NAFTA, given the importance of high quality and transparent statistical reporting of government procurement and the significance of the trade relationships with Canada and Mexico. The Administration is currently reassessing NAFTA. USTR will seek to ensure that the exchange of procurement statistics is considered as part of the ongoing reevaluation.
    Recommendation: The U.S. Trade Representative should, with appropriate experts in Commerce, OMB, and GSA, improve the U.S. methodology for providing federal government procurement statistics to the WTO to ensure both accurate and more timely reporting, consistent with GPA requirements--for example, by providing preliminary estimates and updated values of covered federal procurement or by using an alternative methodology that bases measures of covered government procurement on actual annual obligations, if USTR determines that such an approach is consistent with WTO obligations.

    Comments: On May 10, 2017 USTR officials the revised U.S. approach for reporting GPA-covered procurement adopted in 2015 provides significantly more accurate statistics, but at the cost of timeliness. USTR, in coordination with DOC, is working to further revise the methodology for the preparation and submission of statistics on federal procurement covered by the GPA. They expected that this revised methodology will include both preliminary estimates and updated values of covered federal procurement, per the GAO recommendation.
    Recommendation: The U.S. Trade Representative should, in consultation with appropriate experts in Commerce, OMB, and GSA, develop a methodology for reporting statistics on state governments' covered procurement to the WTO consistent with GPA requirements.

    Comments: On May 10, 2017 USTR officials said that despite noting significant challenges in preparing accurate U.S. state-level statistics on government procurement, we did not identify any concrete steps to improve the accuracy of state-level statistics. Officials have begun to research the issue and found eight states covered by the GPA currently make procurement statistics available in an on-line searchable format, but none of those states indicates the value of procurements covered by trade agreements. Nonetheless, USTR, in consultation with DOC (ITA and Census), is assessing methods for preparing more accurate state-level statistics.
    Recommendation: The U.S. Trade Representative should, in consultation with appropriate experts in Commerce, OMB, and GSA, ensure that methodologies and data sources used to prepare GPA statistical notifications are documented.

    Comments: On May 10, 2017 USTR officials said as USTR and DOC work to develop new methodologies for federal and state-level statistical submissions, they are documenting the decision-making process and the final methodology. Additionally, as part of the data documentation process, DOC has agreed to maintain a database of the source data used in the preparation of both federal and state-level statistics. DOC and USTR are also taking additional steps to ensure the accuracy of all statistics submitted to the WTO.
    Recommendation: The U.S. Trade Representative should, in consultation with appropriate experts in Commerce, OMB, and GSA, ensure that calculations using U.S. procurement statistics and other data are reviewed for accuracy before reporting them to the WTO.

    Recommendation: To inform DOT's development of its national freight strategy and associated freight efforts, such as states' development of freight plans, newly established freight funding programs, and advancing DOT's efforts to implement national freight policies, in the development of the freight data strategy, the Secretary of Transportation should include a specific plan to identify: (1) appropriate freight data sources, information, and analytic tools for transportation modes involved in the freight network and supply chains; (2) data gaps that could help both the agency and states and local governments in the development of their freight plans, and an approach for addressing obstacles to developing high-quality, reliable supply chain information; (3) current and planned efforts that can provide insights into supply chains and their impacts on freight networks; and (4) how DOT plans to use the supply chain information and analytical tools to inform freight planning and programming.

    Recommendation: To better manage the AD/CV duty liquidation process, CBP should issue guidance directing the Antidumping and Countervailing Duty Centralization Team to (a) collect and analyze data on a regular basis to identify and address the causes of liquidations that occur contrary to the process or outside the 6-month time frame mandated by statute, (b) track progress on reducing such liquidations, and (c) report on any effects these liquidations may have on revenue.

    Comments: CBP concurred with this recommendation and said it would take steps to implement it. CBP has issued guidance requiring the collection, analysis, and reporting of AD/CV data to identify and address the causes of liquidations that occur contrary to the process or outside the 6-month time frame mandated by statute, as GAO recommended in July 2016. CBP is analyzing the results of its fiscal year 2017 self-inspection program to assess its progress on reducing such liquidations and report on the revenue effect. CBP expects to complete its analysis by Fall 2017. Systematically collecting and analyzing liquidation data on a regular basis to identify and address the causes of untimely liquidations and tracking and reporting on progress toward reducing such liquidations could help CBP reduce revenue loss.
    Recommendation: To improve risk management in the collection of AD/CV duties and to identify new or changing risks, CBP should regularly conduct a comprehensive risk analysis that assesses both the likelihood and the significance of risk factors related to AD/CV duty collection. For example, CBP could construct statistical models that explore the associations between potential risk factors and both the probability of nonpayment and the size of nonpayment when it occurs.

    Comments: CBP concurred with this recommendation and said it would take steps to implement it. As of September 2017, CBP had not regularly conducted a risk analysis that assesses both the likelihood and significance of risk factors related to AD/CV duty collection, as GAO recommended in July 2016. However, CBP was in the process of developing a model to enable it to conduct such a risk analysis on a regular basis. CBP expects to test the model by Fall 2017; however, CBP officials said that full implementation of the model will not take place until the end of fiscal year 2018 due to the complexity of the project. CBP officials noted that they are working to hire additional staff to dedicate to model development; acquire a dedicated server for processing data to regularly update the models; and identify other CBP programs that would benefit from risk models similar to the ones they are developing for AD/CV duties. Regularly conducting a comprehensive risk analysis of factors related to AD/CV duty non-collection could enhance CBP's capacity to collect additional revenue. For example, it could result in the identification of new factors generating a requirement for an importer to provide additional security in the form of bonds as part of an enhanced bonding requirement.
    Recommendation: To improve risk management in the collection of AD/CV duties, CBP should, consistent with U.S. law and international obligations, take steps to use its data and risk assessment strategically to mitigate AD/CV duty nonpayment, such as by using predictive risk analysis to identify entries that pose heightened risk and taking appropriate action to mitigate the risk.

    Comments: CBP concurred with this recommendation and said it would take steps to implement it. As of September 2017, CBP was in the process of developing a risk analysis model to use in mitigating AD/CV duty nonpayment, as GAO recommended in July 2016. The model will use predictive risk analysis to identify entries that pose a heightened risk of nonpayment. CBP has contacted the Customs Surety Association and the Commercial Customs Operations Advisory Committee to discuss bonding options to help mitigate the risk of nonpayment. Developing a risk analysis model to use in mitigating AD/CV duty nonpayment could enhance CBP's capacity to collect additional revenue. For example, it could be used to identify entries from importers requiring additional security in the form of bonds as part of an enhanced bonding requirement.

    Recommendation: To provide increased performance audit coverage of Commerce's bureaus and offices, the Commerce IG should augment the OIG's risk-based audit planning process to consider (1) a rotation of performance audit coverage among the smaller bureaus and offices to help ensure that the economy, efficiency, and effectiveness of their programs are periodically reviewed and (2) all applicable high-risk areas identified by GAO.

    Status: Open

    Comments: The Department of Commerce's Office of Inspector General (OIG) has taken actions to augment its annual risk assessment to consider (I) a rotation of performance audit coverage among the smaller bureaus and offices and (2) all applicable high-risk areas identified by GAO. For example, OIG's fiscal year (FY) 2016 audit plan included performance audits of Bureau of Industry and Security, Economic Development Administration, and Economic Development Administration, which are three of Commerce's smaller bureaus. It also included a performance audit of federal real property, a high-risk area identified by GAO. Further, OIG indicated completion of its FY 2017 risk assessment in June, and will be completing its FY 2017 audit plan in September - which will include performance audits of several of the Commerce's smaller bureaus, as well as consider the following high-risk areas identified by GAO in its 2015 report that could be applicable to Commerce. We believe OIG met the intent of GAO recommendation with regards to augmenting its annual risk assessment to consider (1) a rotation of performance audit coverage among the smaller bureaus and offices and (2) all applicable high-risk areas identified by GAO. We base our conclusion given that OIG has either conducted or scheduled to conduct performance audits to cover smaller bureaus and high-risk areas identified by GAO, which we verified on the OIG's website. However, we believe the intent of GAO's recommendation is for these audits to be performed in subsequent years going forward and not just in FY 2017. OIG was not able to provide us support to show it has formal procedures or policies in place to ensure these performance audits will be performed in future years on a rotational and periodic basis. As a result, we don't believe DOC OIG has fully met the intent of the recommendation. We will continue to monitor the agency's actions to address this recommendation.
    Recommendation: To provide reasonable assurance that written hotline policies and procedures are consistently followed and complaints are handled effectively, the Commerce IG should enhance the existing internal control activities for the OIG's hotline operations through monitoring, including self-assessment evaluations conducted by the hotline unit of itself, periodic reviews of control design, and direct testing of internal controls.

    Status: Open

    Comments: The Department of Commerce's Office of Inspector General (OIG) stated that it conducted a self-assessment of its hotline operations in fiscal year 2016, updated its complaint management policy, and is securing independent quality control reviews. We have reviewed OIG quality assessment memorandum dated 11/3/15 and verified it shows that OIG performed a self-assessment of its hotline operations, which included (1) evaluating proper handling of complaints; (2) assignment of disposition codes; and (3) time frames for processing complaints. In addition, we have reviewed OIG's updated complaint management policy and verified it contains detailed policies and procedures over its hotline operations. Therefore, we believe OIG met the intent of the recommendation with regards to conducting a self-assessment evaluation. However, we did not see where OIG met the intent of GAO recommendation with regards to having in place control activities for conducting periodic reviews of control design and direct testing of internal controls. We will continue to monitor the agency's actions to address this recommendation.

    Recommendation: To improve policymakers' and the public's understanding of progress through bilateral dialogues in increasing access to China's markets, the U.S. Trade Representative, in conjunction with the Secretary of Commerce and the Secretary of the Treasury, should work to provide clearer and more comprehensive reporting on the status of China's implementation of its JCCT and S&ED trade and investment commitments. This reporting should include more complete information on the status of implementation of these commitments, as well as a more clearly identified source for consolidated information, which could be an existing report.

    Comments: USTR has taken steps to implement this recommendation, but additional information on the status of specific commitments would further improve understanding of progress in these bilateral dialogues. USTR made changes to the Chinese trade barriers reporting in its 2014 National Trade Estimate Report on Foreign Trade Barriers (NTE report) to align more closely with other Congressional reports prepared by USTR on related issues. USTR also provided updated information in that NTE report on China's compliance with a commitment that had not been reported on in earlier reports. Further, USTR identified the Report to Congress on China's WTO Compliance as the one report among the various annual reports prepared by USTR that provides comprehensive information on the status of the trade and investment commitments that China has made through the U.S.-China Joint Commission on Commerce and Trade (JCCT) and the U.S.-China Strategic and Economic Dialogue (S&ED). As of July 2017, GAO is continuing to track agency progress in reporting on these commitments.

    Recommendation: As part of the development of a national maritime strategy and a national freight strategic plan, the Secretary of Transportation should direct MARAD--in consultation with maritime industry stakeholders--to study and identify any potential problems in ensuring that U.S. mariners are adequately trained to meet the needs of the entire maritime industry, including the domestic waterways. Public forums, such as MARAD's roundtable discussions, could serve as a means for gaining industry input on potential training issues.

    Comments: On April 7, 2017 GAO requested an update on the status of MARAD's position on whether or not the recommendation would be implemented. In June 2016, MARAD indicated that it had not made this determination. In response to GAO's latest inquiry, MARAD indicated that it was in the process of checking on whether any action had been taken within the agency to implement the recommendation.

    Recommendation: To improve the consistency, comprehensiveness, and transparency of information provided to Congress and policymakers on the federal investment in export promotion programs, the Secretary of Commerce, as chair of the TPCC, should report in its National Export Strategies on how resources are allocated by agency and aligned with priorities.

    Priority recommendation

    Comments: The Trade Promotion Coordinating Committee (TPCC) has not yet reported in its National Export Strategies (NES) on how resources are allocated by agency and aligned with the strategy's priorities. The TPCC did not issue National Export Strategies in fiscal years 2014 or 2015, but did issue one in 2016, but it did not include any budget information. According to TPCC Secretariat officials, as of June 2017 they had collected budget information arrayed by strategic categories from most of the principle TPCC agencies and were considering sending it to congressional stakeholders outside of an NES. However, the new 2017 budget and proposed 2018 budget from the new administration may make the information they have collected out of date.

    Recommendation: To more effectively implement SBA's expansion of OIT field staff as required by the SBJA, the Administrator of the SBA should update SBA's plan for additional OIT staff to include funding sources and time frames, as well as possible efficiencies from clearly defining roles and responsibilities and leveraging other entities' export assistance resources.

    Comments: SBA concurred with our recommendations and noted that SBA would work to implement the recommendations. SBA agreed that it intends to respond to staffing requirements of the SBJA while acknowledging resource constraints in its next annual report to Congress. In November 2014, SBA officials said that SBA was in the process of evaluating the impact of Voluntary Early Retirement Authority (VERA) and Voluntary Separation Incentive Payments (VSIP) retirements that took place at the end of September 2014 and was developing a plan for reallocating full-time employees (FTEs). They said that at the end of this process, SBA would have a better understanding of the impact on current and future USEAC staffing levels. In September 2015, SBA stated that it was still in the process of evaluating the impact of the VERA/VSIP retirements that took place at the end of September 2014, and was developing a plan for current and future FTEs. In February 2016, SBA's Office of International Trade (OIT) reported that in the first quarter of fiscal year 2016, it was able to fill the 21st of 30 USEAC-based Export Finance Specialist positions. OIT also reported that it has prepared an updated staffing proposal for the remaining nine positions called for under the Small Business Jobs Act of 2010. OIT noted that filling the remaining nine positions would depend on their receiving additional agency funding. SBA needs to provide documentation of its plan for complying with staffing requirements in the Small Business Jobs Act, or provide evidence that they have reallocated resources to actually do so. As of March 2017, SBA's new leadership was reviewing agency budget and staffing needs and had not provided us with a proposal for filling the remaining positions.

    Recommendation: To ensure that the performance measures used to evaluate the TAA for Firms program demonstrate program results and to help ensure that EDA can comprehensively evaluate the effectiveness of the program, the Secretary of Commerce should broaden the program's evaluation approach, for instance, by developing additional quantifiable outcome-oriented performance goals and measures for key program areas and conducting further analysis of the data to isolate the impact of the TAA for Firms program from other influences, such as economic trends.

    Comments: Commerce concurred with our findings and recommendations. In April 2017, EDA provided additional information on its progress in implementing our recommendation. In 2012, EDA commissioned a study to inform the development of performance metrics and evaluation methods for the TAA for Firms program. Issued in October 2014, the study provided recommendations to EDA on potential performance metrics, tested the metrics by conducting a statistical analysis of TAA for Firms clients against a control group as well as a survey, and suggested data sources for conducting future evaluations of the TAA for Firms program. According to EDA officials, the study will help provide a foundation for more robust longitudinal performance measurement and enhanced policy analysis, thereby enabling EDA to more comprehensively evaluate the program. These officials noted that, as of April 2017, EDA is continuing to collaborate with the authors of the study to help develop, validate, and implement recommended performance metrics. According to EDA officials, the authors of the study have finalized an operational toolkit containing recommended metrics and protocols for data collection and impact evaluation methods. EDA plans to review and pilot test these recommended metrics and evaluation methods to improve program evaluation. We will continue to monitor Commerce's efforts to implement our recommendation.
    Recommendation: To improve the data available to manage and evaluate the TAA for Firms program, the Secretary of Commerce should develop a data system to consistently collect, maintain, and analyze sufficiently reliable and up-to-date data on program operations and participant firms.

    Comments: Commerce concurred with our findings and recommendations. In April 2017, EDA provided additional information on its progress in implementing our recommendation. Commerce's Office of the Chief Information Officer has undertaken a variety of activities to improve the efficiency and effectiveness of Commerce's data systems, including those of EDA. According to EDA officials, as of April 2017, EDA is evaluating its agency-wide data system and alternative systems for collecting data on program operations with which to measure program performance. According to these officials, EDA expects that the transition to the new data system for the TAA for Firms program will be completed pending the outcome of the evaluation. We will continue to monitor Commerce's efforts to implement our recommendation.

    Recommendation: To help ensure that FDA's overseas offices are able to fully meet their mission of helping to ensure the safety of imported products, the Commissioner of FDA should ensure, as it completes its strategic planning process for the overseas offices, that it develops a set of performance goals and measures that can be used to demonstrate overseas office contributions to long-term outcomes related to the regulation of imported products and that overseas office activities are coordinated with the centers and Office of Regulatory Affairs (ORA).

    Comments: In August 2017, FDA reported that it remains committed to strengthening its efforts and systematically monitoring and evaluating the overseas offices' contributions to the agency's mission and objectives. FDA also stated that it is making significant progress in several areas by enhancing strategic planning and analysis, refining the Office of International Program's (OIP) performance metrics, and designing a monitoring and evaluation plan. For example, FDA stated it has developed a framework with refined performance metrics to distinguish and assess the distinct contribution of OIP and its foreign offices towards program objectives and broader agency goals. FDA said that the performance metrics will track and monitor the quantity, quality, and timeliness of activity outputs and intermediate outcomes resulting from OIP's work. The measures have been standardized and defined, and will be further disaggregated to enable various levels of analyses, including distinguishing the unique efforts by foreign offices and product type. According to FDA, it plans to roll out its performance framework, related metrics, and monitoring and evaluation processes in fiscal year 2018. FDA said it anticipates that its performance measures, enhanced monitoring, and increased sharing of best practices across foreign offices and FDA headquarters will facilitate tracking of performance, allow greater accountability, and provide a foundation for continuous improvement. GAO will continue to monitor FDA's progress.
