    Recommendation: To ensure that the financial benefits of EULs that the Department of Veterans' Affairs reports in its annual Consideration Report on the EUL program are transparent and reliable, the Secretary should revise its Enhanced-Use Leasing Post Transaction Handbook (Handbook 7454) and specify that VA will: (1) Report consistently the enhanced services benefits from its EULs separately from other financial benefits that directly affect VA's budget, and (2) Include an explanation in its reporting on estimated EUL enhanced services that its estimates may not adequately capture all benefits of the EUL project and that certain costs associated with providing such benefits that are incurred by parties outside VA are not included in the analysis.

    Recommendation: To enhance the department's transfer of its excess controlled property, and to strengthen LESO program internal controls for the application and enrollment of federal agencies, the Under Secretary of Defense for Acquisition, Technology and Logistics should direct the Director of DLA to review and revise policy or procedures for verifying and approving federal agency applications and enrollment. For example, such steps could include LESO supervisory approval for all federal agency applications; confirmation of the application with designated points of contact at the headquarters of participating federal agencies; or visiting the location of the applying federal law enforcement agency.

    Recommendation: To help ensure that the government is not exposed to more liability risk than intended, the Secretary of Transportation should ensure that the FAA Administrator prioritizes the development of a plan to address the identified weakness in the cost-of-casualty amount, including setting time frames for action, and update the amount based on current information.

    Comments: The Department of Transportation agreed with the recommendation. As of May 2017, the Federal Aviation Administration (FAA) plans to seek feedback from the commercial space and insurance industries to obtain views on an appropriate cost-of-casualty amount and implications of any changes. After receiving this input, FAA will determine whether to modify the cost-of-casualty amount and initiate action. We will continue to monitor FAA's actions in response to this recommendation.

    Recommendation: To provide Congress with better visibility over the costs for the environmental cleanup of properties from all Base Realignment and Closure rounds to inform future funding decisions, the Secretary of Defense should direct the Secretaries of the military departments to include in future annual reports to Congress that environmental cleanup costs will increase due to the cleanup of perfluorinated compounds and other emerging contaminants, and to include best estimates of these costs as additional information becomes available.

    Recommendation: To help the services more effectively share information and address environmental cleanups and transfers, the Secretary of Defense should direct the Secretaries of the military departments to create a repository or method to record and share lessons learned about how various locations have successfully addressed cleanup challenges.

    Recommendation: To improve VA's supportive-housing EUL program and meet the needs of homeless veterans, the Secretary of Veterans Affairs should direct the Office of Asset Enterprise Management to clearly and completely document the selection process for all supportive-housing EULs from pre-development through completion of VA's development phase in keeping with internal control standards and VA policy.

    Comments: On September 19, 2017, an official from VA's Office of Capital Operations and Program Service said that the Office of Asset Enterprise Management (OAEM) is working with the Office of Information and Technology to ensure that the Enhanced Use Lease (EUL) Directive, Handbook, and Attachments are 508 compliant. This requirement is the last step in VA's internal process to certify and publish the updated EUL Directive and Handbook. Once OAEM receives an estimate when this process will be completed, VA will provide GAO a status update with the expected completion date for the updated EUL Directive and Handbook.
    Recommendation: To improve VA's supportive-housing EUL program and meet the needs of homeless veterans, the Secretary of Veterans Affairs should direct the Office of Asset Enterprise Management to update its EUL policy to (1) address the current authority for developing supportive-housing; and (2) specify how to identify properties for supportive-housing EULs to meet the needs of homeless veterans.

    Recommendation: To help ensure that the CFTC makes cost-effective leasing decisions, and considers options for reducing future lease costs, prior to entering into any new or expanded lease agreements, the Chairman of the CFTC should ensure that as CFTC revises its leasing policies and procedures, it includes comprehensive details on lease procurement that are consistent with leading government guidance and standards to assure cost-effective decisions.

    Comments: On July 5, 2017, CFTC told us that in August, 2016, it had entered into a Memorandum of Understanding (MOU) with the General Services Administration (GSA), whereby GSA will procure and administer all new leases for CFTC consistent with GSA policies and procedures. The MOU provides a framework by which GSA will apply its expertise in the leasing field to satisfy CFTC's real property space requirements, while ensuring compliance with appropriations laws and regulations applicable to real property transactions. GSA will procure new CFTC leases consistent with CFTC's demonstrated needs and requirements, GSA's practices and procedures as well as relevant statutes, Executive Orders, and supplemental agency policies and guidance. As part of its service offering, GSA will work with CFTC to maximize and increase efficiency in its planning for future space requirements and to consider alternatives to acquiring additional office space, such as consolidation, co-location, teleworking, and hoteling. CFTC has retained all responsibilities for its existing leases, but will leverage GSA's experience for administering them. Through the MOU, GSA will consult with and advise CFTC in administering its existing leases, which may also include implementing one or more of the initiatives described above for maximizing the efficiency of CFTC's current leasing inventory.
    Recommendation: To help ensure that the CFTC makes cost-effective leasing decisions, and considers options for reducing future lease costs, prior to entering into any new or expanded lease agreements, the Chairman of the CFTC should establish a timeline for evaluating and documenting options to potentially improve space utilization and reduce leasing costs including, but not restricted to, (1) moving offices to less costly locations, (2) implementing enhanced telework, and (3) consolidating the Kansas City and Chicago regional offices.

    Recommendation: To improve risk assessments for repair and alteration projects, the Administrator of GSA should develop and implement a plan to periodically analyze information GSA already collects, for example, based on a representative sample of repair and alterations projects, in order to: (1) identify the specific impacts unforeseen conditions have had on project costs, schedules, and scope of work; (2) analyze the causes of these conditions for those projects that experienced unforeseen site conditions; and (3) identify actions that will be taken to address the potential causes of unforeseen site conditions.

    Comments: GSA said it is working to study potential unforeseen site conditions on repair and alteration projects. Based on the identification of new categories of unforeseen site conditions, GSA will implement plans to prevent and mitigate such unforeseen site conditions on future projects. Specifically, GSA will conduct a study of change orders. GSA will then analyze conditions and identify possible categories of unforeseen site conditions. GSA will include assessment of causes and impact on schedule and budget, and also assess potential causes of unforeseen site conditions. Finally, GSA will develop plans to address potential causes and mitigate risks of unforeseen site conditions. We will continue to follow-up with GSA to confirm that it follows through with these actions.

    Recommendation: To improve DOD's ability to oversee its inventory of leased real property, aimed at improving the accuracy and completeness of data in RPAD, the Secretary of Defense should direct the Secretary of the Army to enforce DOD's Real Property Inventory (RPI) Reporting Guidance, which states that for multiple assets associated with a single lease, the military departments and WHS must provide a breakout of the annual rent plus other costs for each asset on the same lease, to avoid overstating costs associated with such leases.

    Comments: DOD concurred with our recommendation that Secretary of the Army enforce DOD's Real Property Inventory (RPI) Reporting Guidance to break out the annual rent plus other costs for each asset on the same lease to avoid overstating the costs associated with such leases.     Recommendation: To help reduce facility costs and reliance on leased space, the Secretary of Defense should direct the Secretaries of the military departments to require that their departments look for opportunities to relocate DOD organizations in leased space to installations that may have underutilized space due to force structure reductions or other indicators of potentially available space, where such relocation is cost-effective and does not interfere with the installation's ongoing military mission.

    Comments: DOD did not concur with our recommendation that the military departments look for opportunities to relocate DOD organizations in leased space onto installations that may have underutilized space. As of October 2016, DOD has not completed any actions to implement this recommendation.
    Recommendation: To improve DOD's ability to ensure that its leased facilities are secure, the Secretary of Defense should direct the Under Secretary of Defense (Intelligence) to request reports from the Federal Protective Service for all leased facilities on a periodic basis as determined necessary for oversight. At a minimum, the Under Secretary should request (1) the results of the assessments, (2) the date on which the last assessment was completed for each facility and the date for which the next scheduled assessment is planned, and (3) information on whether these dates meet the time frames established by Interagency Security Committee standards.

    Comments: DOD concurred with our recommendation that DOD improve its ability to ensure that its leased facilities are secure and stated that it would collaborate with the Federal Protective Service to obtain the listing of the leased facilities the agency supports, monitor and provide oversight of the scheduling of the assessments, and review the results of the assessments. As of October 2016, DOD has not completed any actions to implement this recommendation.
    Recommendation: To improve DOD's ability to oversee its inventory of leased real property, aimed at improving the accuracy and completeness of data in RPAD, the Secretary of Defense should direct the Assistant Secretary of Defense (Energy, Installations and Environment) to modify the office's Real Property Information Model to include a data element to capture the square footage for each lease of space in a single building and also make a corresponding change to its Real Property Inventory (RPI) Reporting Guidance to require that the square footage for each individual lease be reported when multiple leases exist for a single building, to avoid overstating the total square footage assigned to each lease in RPAD.

    Recommendation: As part of its lease reform efforts and to increase possible cost savings, the GSA Administrator should seek to reduce leasing costs for federal agencies by exploring, with relevant stakeholders, the possibility of loaning unobligated Federal Buildings Fund balances to agencies to cover tenant improvement costs that would otherwise have to be financed for new leases. If GSA finds that, with sufficient controls in place, tenant improvements can be safely funded this way, it should participate in the development of a legislative proposal to request that Congress make the necessary budget authority available.

    Comments: GSA agreed with the recommendation to reduce leasing costs for federal agencies by exploring the possibility of loaning unobligated Federal Building Fund (FBF) balances to agencies to cover tenants' improvement costs. In June 2016, GSA told us research is under way to establish the parameters of the annual financial impact of tenant improvement allowances on the unobligated Federal Buildings Fund balance. GSA's considerations will include defining the impact to the FBF balance of financing agencies' tenant improvement allowances, which would compete with the limited dollars available for new construction and major repairs and alterations. As of October 20, 2016, GSA had not provided GAO with additional updates to the status of this recommendation.
    Recommendation: As part of its lease reform efforts and to increase possible cost savings, the GSA Administrator should seek to reduce leasing costs for federal agencies by allowing tenant agencies the option of choosing non-cancelable occupancy agreements with lower administrative costs, particularly for leases with firm terms of 5 years or less.

    Recommendation: To assist in determining progress toward a long-term, sustainable portfolio, the Administrator of GSA should identify the gap between the portfolio's current level of performance and the level necessary to sustain the portfolio. As part of this effort, GSA should review its tiering and core asset analysis measures and update them to provide more precise measures that can be used in identifying this performance gap.

    Comments: As of June 2017, GSA has developed an Asset Repositioning Tool to build upon and replace its tiering and core asset analysis measures. The tool uses 10 measures of asset performance related to customer, asset, and market indicators to determine an asset's performance. According to GSA, the tool allows for a more refined analysis in determining an asset's performance and enables GSA to identify and rank assets that should be held long-term and those which are low-performing and should be studied to determine their future place in the portfolio. GSA intends to use the tool at the start of every fiscal year to analyze its portfolio and use the results to inform its investment decisions and decisions to hold or dispose of lower-performing assets. GSA believes that use of the tool to support its asset management practices will enable it to better assess the performance gap within and take actions to promote the sustainability of its portfolio. GAO will continue to monitor GSA's efforts to implement this tool in assessing asset performance and using the results to work toward establishment of a long-term, sustainable portfolio.

In an April 2017 follow up, DOD stated that it plans to address our recommendations regarding the BRAC homeless assistance process when Congress provides BRAC authorizing legislation. DOD added that it will work closely with the military Departments and HUD staff in the process of revising the implementing regulation.

    Comments: HUD generally concurred with the recommendation to update the BRAC homeless assistance regulations to require that conveyance statuses be tracked, which could include requiring DOD to track and share disposal actions with HUD and requiring HUD to track the status following disposal. HUD stated that it is willing to update the BRAC homeless assistance regulations to track the conveyances of property for homeless assistance, but noted that it will require DOD agreement to do so because the regulations are joint. In a March 2017 follow up, HUD stated it will address GAO recommendations regarding the BRAC homeless assistance process when Congress provides BRAC authorizing legislation. HUD added it would be premature to make any changes to current implementing policies or regulations which could be impacted by new BRAC authorizing legislation. HUD stated it will work closely with the military departments and DOD staff in the process of revising the implementing regulation.
    Recommendation: To assist homeless assistance providers and LRAs in completing the steps of the BRAC homeless assistance process within required time frames, to provide additional information to reduce unfulfilled expectations about the decisions made in executing the homeless assistance agreements, and to promote a greater dissemination of this information, the Secretaries of Housing and Urban Development and Defense, for each of the following four elements, should update the BRAC homeless assistance regulations; establish information-sharing mechanisms, such as a website or informational pamphlets; or develop templates to include specific guidance that clearly identifies the information that should be provided to homeless assistance providers during tours of on-base property, such as the condition of the property.

    Comments: DOD partially concurred with the recommendation to update the BRAC homeless assistance regulations, establish information-sharing mechanisms, or develop templates to include specific guidance that clearly identifies the information that should be provided to homeless assistance providers during tours of on-base property, such as the condition of the property. DOD stated that while it already provides generic information about the property, the LRAs and interested homeless assistance providers can undertake facility assessments following the tours.
