    Comments: On May 10, 2017 USTR officials said the United States has long struggled with the challenges associated with comparing statistics produced by the United States with statistics provided by U.S. trading partners where there are inconsistencies in statistical reporting. To respond to this known challenge, USTR led an effort to establish a work program on statistical reporting during the revised GPA negotiations. The WTO GPA statistical work program calls for parties to make recommendation on four issues: 1) whether the GPA Parties should adopt a common method for collection of statistics; 2) whether the GPA Parties are able to standardize the classifications in the statistical data reported to the GPA Committee; 3) means for facilitating the collection of country of origin of goods and services covered by the agreements; and 4) other technical issues in government procurement data reporting raised by any GPA Party. In 2017, USTR assumed the chair of the work program as part of its effort to ensure that the GPA Parties continue to make progress in their work on these recommendations. On April 27, 2017, USTR tabled a proposal that identifies outstanding issues preventing GPA Parties from improving the quality of statistical reporting. GPA Parties have agreed to discuss these issues at another work program meeting chaired by USTR in June 2017.

In October 2016, OMB issued a draft circular on category management establishing that spend under management will be the principal measure OMB will use to assess agency adoption of category management. CFTC has retained all responsibilities for its existing leases, but will leverage GSA's experience for administering them.     Comments: As of December 2017, DOD is pursuing an effort to standardize and consolidate leases, according to an official from the Office of the Secretary of Defense. The official stated that the effort's initial emphasis was on 176 leased facilities located within 35 miles of DOD-owned facilities that had underutilized or excess space and are up for renewal over the next 5 years. The effort will develop criteria for reviewing these leases, including a cost-benefit analysis of whether it is feasible to relocate the function in leased space to existing space on an installation. Alternatively, if it is determined that the function cannot be moved, DOD will review whether to consolidate the lease to appropriately size the space to the function's requirement. When this effort is completed, DOD may have opportunities to reduce its leased space at a DOD-wide level.
    Recommendation: To improve DOD's ability to ensure that its leased facilities are secure, the Secretary of Defense should direct the Under Secretary of Defense (Intelligence) to request reports from the Federal Protective Service for all leased facilities on a periodic basis as determined necessary for oversight. At a minimum, the Under Secretary should request (1) the results of the assessments, (2) the date on which the last assessment was completed for each facility and the date for which the next scheduled assessment is planned, and (3) information on whether these dates meet the time frames established by Interagency Security Committee standards.

    Comments: GSA agreed with the recommendation to reduce leasing costs for federal agencies by exploring the possibility of loaning unobligated Federal Building Fund (FBF) balances to agencies to cover tenants' improvement costs. In June 2016, GSA told us research is under way to establish the parameters of the annual financial impact of tenant improvement allowances on the unobligated Federal Buildings Fund balance. GSA's considerations will include defining the impact to the FBF balance of financing agencies' tenant improvement allowances, which would compete with the limited dollars available for new construction and major repairs and alterations. As of October 20, 2016, GSA had not provided GAO with additional updates to the status of this recommendation.

    Comments: As of August 2017, according to Department of Defense (DOD) officials, the department has made progress in developing a systematic process for sharing information on excess serviceable ammunition and plans, as GAO recommended in July 2015, but has not fully implemented that process. Specifically, the Army?s Office of the Deputy Chief of Staff for Logistics signed a memorandum of understanding with the Defense Logistics Agency (DLA) Disposition Services that established a process where DLA will assist the Army in transferring some excess DOD ammunition to federal, state, and local law enforcement agencies. Annually, the Army will provide DLA with a list of available types and quantities of excess ammunition that is 7.62 millimeters and smaller. DLA Disposition Services will inform participating law enforcement agencies of the ammunition available, screen all requests received from law enforcement agencies, and forward all approved law enforcement agency requests to the Army. The Army will prepare all necessary issue documents; pack and ship, on a reimbursable basis, ammunition to law enforcement agencies identified by DLA; and notify DLA and law enforcement agencies of any changes in condition of the ammunition. DOD and DLA conducted a pilot of this process from November 2016 to June 2017 in which DOD, through DLA, shared information on excess small arms ammunition with federal, state, and local law enforcement agencies. As a result, DOD transferred 1,209,095 rounds of 5.56-millimeter ammunition and 200,000 rounds of 9-millimeter ammunition to federal, state, and local law enforcement agencies. Since DOD was able to transfer this ammunition to another government agency, it does not have to pay to demilitarize (i.e. dispose of) the ammunition, which saved DOD about $60,000 in demilitarization costs. DOD officials stated that they are currently updating the Joint Conventional Ammunition Policies and Procedures (JCAPP) to formalize the procedures to accurately identify, execute, and track future transfers of excess small arms ammunition to federal, state, and local law enforcement agencies. Once JCAPP is updated, this recommendation would be considered fully implemented.

The June 2016 report from the contractor provided FEMA with information on the types of flood damage agricultural buildings and contents can sustain, required mitigation measures under NFIP, and insurance that is currently available to farmers. Phase 2 of the study is underway. This phase will identify the number and types of agricultural structures and the legislation, regulations, and various agency programs affecting the management of these structures; analyze the feasibility of mitigation options for these structures across different types of floodplains; and explore rating guidelines and potential mitigation techniques that could result in reduced risk or rates for agricultural structures.     Comments: As of July 2017, OMB and Treasury were working to implement the DATA Act, which includes several provisions that may address these recommendations once fully implemented. 1) OMB staff said they continue to deliberate on agency responsibilities for reporting awards funded by non-annual appropriations. 2) OMB staff provided a Frequently Asked Question (FAQ) addressing the applicability of USASpending.gov reporting requirements for recipient information related to classified or sensitive information. GAO reviewed the FAQ and determined that additional guidance is still needed to ensure complete reporting of unclassified awards as required by FFATA. 3) OMB staff have agreed that it will be important to clarify guidance on how agencies can report on award titles that appropriately describes the awards' purposes and noted that they are working on providing additional guidance to agencies as part of their larger DATA Act implementation efforts. 4) OMB released policy guidance in May 2016 (MPM 2016-03) that identifies the authoritative sources for reporting procurement and award data. However, GAO's review of this policy guidance determined that it does not address the underlying source that can be used to verify the accuracy of non-financial procurement data or any source for data on assistance awards.

    Comments: As part of their DATA Act implementation efforts, OMB issued policy guidance in May 2016 (MPM 2016-03) that identifies authoritative systems to validate agency spending information. The guidance also directs agency DATA Act Senior Accountable Officials (SAOs) to provide a quarterly assurance regarding the data reported to USASpending.gov and specifies that this assurance should leverage data quality and management controls established in statute, regulation, and Federal-wide policy and be aligned with the internal control and risk management strategies in Circular A-123, and provides information on how agency DATA Act SAOs are to provide assurances over the spending data reported to USASpending.gov. In addition, Treasury's broker is to provide an additional set of validation rules to further ensure the proper formatting of data submitted to USAspending.gov. OMB staff noted that OMB and Treasury had prioritized the linking of financial data to award data as a means of addressing the issue of unreported awards we previously identified. We agree that linking financial and award data can help agencies identify gaps in reporting. However, as of July 2017, OMB did not identify any new or revised processes aimed at addressing the accuracy concerns we addressed other than citing agencies' responsibility to certify the accuracy of their data.
    Recommendation: To improve the completeness of foreign recipient data on the USASpending.gov website, the Chief Executive Officer of the Millennium Challenge Corporation should direct responsible officials within the Corporation's Department of Administration and Finance to report spending information on all assistance award programs to USASpending.gov for prior and future fiscal years in accordance with statutory requirements and OMB guidance.

    Comments: Based on this recommendation, Congress has requested that the Coast Guard develop a 20-year plan that identifies all acquisitions needed to maintain the Coast Guard's current level of service and the financial commitment necessary to achieve this plan. As a part of a series of testimonies in June and July 2017, we found that Coast Guard officials stated they are developing a 20-year Capital Investment Plan (CIP), but the timeframe for completion is unknown. The Coast Guard does, however, submit a 5-year CIP annually to Congress that projects acquisition funding needs for the upcoming 5 years. GAO found the CIPs do not match budget realities in that tradeoffs are not included. In the 20-year CIP, GAO would expect to see all acquisitions needed to maintain current service levels and the fiscal resources to build the identified assets as well as tradeoffs in light of funding constraints.

    Comments: The Department of Commerce (Commerce) notified GAO that it did not fully concur with GAO's May 2014 recommendation, preferring instead to maintain a case-by-case approach rather than issuing more formal guidance on federal information sharing with state trade offices. According to Commerce, as of March 2016, the agency was in the process of implementing a new client relationship management system. Commerce officials said that as future iterations of this system and public websites come online, they would seek to identify ways for clients to give permission to release information useful to other federal agencies, state trade offices, and other local service providers. In February 2016, Congress passed The Trade Facilitation and Trade Enforcement Act of 2015, Public Law 114-125, which requires that within a year of the act's passing, Commerce must develop a federal-state export promotion coordination plan that addresses, among other things, information sharing between federal and state trade offices. The act also requires Commerce and state trade promotion agencies to develop a framework to share information on export successes, and report to Congress on this framework within a year of the law's enactment. Later in 2016, Commerce officials began holding monthly calls with SIDO and state trade offices to share information on topics such as client intake, performance measures, and new federal export promotion activities. In March 2017, Commerce officials informed GAO that after further review of information-sharing limitations under the Trade Secrets Act, Commerce has determined that Written Impact Narratives (WINs) that have been approved for public use by the clients can be shared with State trade agencies. Commerce is currently developing a policy to ensure they are shared in a timely manner. In addition, the newly formed Trade Promotion Coordinating Committee (TPCC) state and federal export promotion working group is expected to create a framework for information sharing. Without greater information sharing in the provision of similar services, Commerce will likely be limited in its ability to help ensure that export promotion services are efficiently managed across federal and state efforts, and that resources are appropriately leveraged.
    Recommendation: To improve federal-state collaboration in providing export promotion services in accordance with the National Export Initiative, and the Export Enhancement Act of 1992, the Secretary of Commerce, as Chair of the TPCC, should take steps consistent with key practices for collaboration to enhance TPCC agencies' partnering on export promotion with nonfederal entities, such as State International Development Organizations and Global Cities. This could include reassessing and strengthening the TPCC's intergovernmental partnerships by clarifying expected outcomes, defining roles and responsibilities, monitoring results, and planning resource needs.

    Comments: The Department of Commerce (Commerce) and the Trade Promotion Coordinating Committee (TPCC), which is responsible for providing a unified national framework for export promotion, have taken some steps to enhance federal-state collaboration in export promotion, as GAO recommended in May 2014 and as called for in a subsequent law. In February 2016, Congress passed The Trade Facilitation and Trade Enforcement Act of 2015, Public Law 114-125, which according to the State International Development Organizations (SIDO), contained provisions intended to enhance federal-state collaboration in export promotion. First, the act directs the President to establish a state and federal export promotion coordination working group as a subcommittee of the TPCC and appoint at least one representative from a state trade promotion agency to the TPCC. Second, beginning in February 2017, the act requires Commerce to annually submit to the TPCC a federal-state export strategy for each state that submits its export strategy to Commerce for that year that, among other things, addresses efforts to reduce duplication. Third, the act requires Commerce and state trade promotion agencies to develop a coordinated set of performance metrics, and report to Congress on these metrics within a year of the law's enactment. Fourth, the act mandates an annual survey and analysis, in coordination with state trade promotion agencies, of the overall effectiveness of federal-state coordination in export promotion. In April 2016 Commerce and SIDO signed a memorandum of intent to develop joint strategies and implement activities to enhance federal and state agency coordination and cooperation . In September 2016 Commerce issued a Federal Register Notice announcing the establishment of a state and federal export promotion coordination working group under the TPCC. The Secretary of Commerce appointed 14 members to this new working group in January 2017, which has met several times according to Commerce officials. The working group is developing a federal-state export coordination strategy that is expected to define roles and responsibilities, among other things. Successfully completing these activities is important, because without joint federal-state planning, programs at different levels of government will likely continue to be duplicative, and effective resource planning will likely be hampered.

    Recommendation: To ensure that the risks of professional and management support service contracts are more fully considered and addressed, the Director of OMB, through the Office of Federal Procurement Policy, should include contracts coded in the Federal Procurement Data System - Next Generation (FPDS-NG) as Other Professional Services and Other Management Support Services in the cost savings initiative for management support services and planned service contract inventory guidance to agencies for conducting analysis of special interest functions.

    Comments: In providing comments on our report, the agency concurred with this recommendation but has not yet taken all actions necessary to implement it. Although the Missile Defense Agency (MDA) has received independent cost estimates from its internal independent cost group for some programs and components that support the baselines provided in MDA's Ballistic Missile Defense System Accountability Report (BAR), MDA officials told us they have not yet completed independent estimates for all the BAR baselines. In addition, the independent estimates will not have full lifecycle costs which will hamper their effectiveness. We will continue to monitor MDA's progress over the course of our next annual review.

    Comments: In providing comments on this report, the Department of Defense concurred with our recommendation and has taken initial steps to report the test variances, by laying out the dates of the proposed changes. However, the variances do not include all changes to test objectives, detail when tests are deleted, nor when the altered objectives will be satisfied. MDA has initiated an effort with DOT&E and the OTA to track the movement of test objectives, however these changes are not reported and are only used internally. In addition, MDA utilizes a "mid-year" test change memorandum. The change explains the difference from the prior master test plan, but is not reported. Thus, changes that are included in the mid-year memorandum can not be tracked if one only receives the annual test plan. We will continue to monitor MDA's progress in fiscal year 2017 and determine whether MDA lays out the changes in its upcoming integrated master test plan.

    Comments: In providing comments on this report, the agency concurred with this recommendation. In the June 2010 Ballistic Missile Defense System Accountability Report (BAR), Missile Defense Agency (MDA) provided some operational baselines and continues to do so annually. Nonetheless, configuration changes continue to pose challenges to a thorough assessment of the BMDS architecture. For example, the Director, Operational Test and Evaluation stated that the many configurations of the fielded ground-based interceptor inhibits a full evaluation of the GMD program. Moreover, some changes to BMDS elements are still delivered while testing of the architecture is already underway. We will continue to assess whether MDA fully adopts an approach allowing time for the warfighter and testers to fully understand hardware and software before placing it in the operational baseline.

    Recommendation: To ensure DOD officials are able to gain insight into the risk assessment that is required to be documented in the contract file and the basis for the government's profit or fee negotiation objective, the Secretary of Defense should redesign the weighted guidelines worksheet to explicitly show the incurred cost calculations and a narrative description of the reason for assigning a specific contract-type risk value.

    Comments: In providing comments on this report, the agency concurred with this recommendation but has not completed actions necessary to implement it. Defense Procurement and Acquisition Policy's(DPAP) members have drafted two proposed changes to the Defense Federal Acquisition Regulation Supplemental (DFARS). The first proposed rule is designed to provide a more transparent means of documenting the impact of costs incurred during the undefinitized period of an undefinitized contract action (UCA) on allowable profit. Proposed changes to the worksheet include more transparency and narrative requirements to detail the rationale for contracting officers' assignments of weighted guideline values. In addition to proposed changes to the weighted guideline worksheet, the proposed DFARS rule also provides new narrative requirements for Price Negotiation Memorandums. The second proposed rule changes the undefinitized period for a UCA from UCA award to the date when the government receives a qualifying proposal from the contractor as opposed to the date when the UCA is definitized. These proposed rules are currently being reviewed and approved by senior DOD officials. DPAP expects to finalize these proposed rules sometime later this year. If one or both are approved, the final rules will be published after a 90 day comment period.

    Recommendation: To ensure compliance with federal contracting regulations and to more transparently disclose the extent to which subcontracting opportunities are available to small businesses, the Secretaries of Homeland Security and Defense and the Administrator of General Services should consider asking their respective Inspectors General to conduct a review at an appropriate future date to ensure that this guidance and related requirements are being followed.

    Comments: DHS issued a chapter on its small business subcontracting program in its DHS Acquisition Manual in October 2009 and developed a subcontracting plan checklist that officials are to use when awarding a contract. In May 2010, DHS officials stated that these documents were examples of progress they have made to address the recommendation on ensuring compliance with federal contracting regulations and other related requirements. We disagreed with the agency and do not believe that these documents constitute agency guidance on the contract administration duties to monitor contractor compliance with subcontracting plan reporting requirements. In the fall of 2017, we met with DHS officials to discuss the recommendation. Subsequently, in September 2017, DHS emailed a description of the role of the OSDBU in ensuring that: (a) prime contractors report timely on their small business subcontracting accomplishments, and (b) determinations that call for no subcontracting plans are properly vetted. We requested formal documentation of the roles and responsibilities of the OSDBU, as well as evidence of the work performed, in September 2017. The recommendation remains open until DHS provides documentation to support its written description of the OSDBU's efforts to help ensure guidance and related requirements related to subcontracting opportunities for small businesses are being followed.
