    Recommendation: To better ensure FEMA's regional activities effectively support individuals with disabilities, the Secretary of Homeland Security should direct the FEMA Administrator to take steps to establish written procedures for how regions should involve the Office of Disability Integration and Coordination in clarifying disability integration staff's roles, evaluating staff performance, and setting expectations for how staff communicate with headquarters and the regions.

    Comments: FEMA agreed with this recommendation and FEMA's Office of Disability Integration and Coordination is in the process of establishing a working group that will clarify and codify the roles, responsibilities, and expectations among the various agency offices and personnel involved in carrying out the agency's disability integration mission. GAO will monitor the progress of these efforts. FEMA expects to complete these efforts by December 31, 2017. At that time, GAO will await documentation of the agency's procedures for carrying out its disability integration mission.
    Recommendation: To better position FEMA to expand access to key training on incorporating access and functional needs into emergency planning for state, local, and voluntary organization emergency management officials, the Secretary of Homeland Security should direct the FEMA Administrator to evaluate alternative cost-effective methods for delivering its course on access and functional needs, such as via virtual classes.

    Comments: FEMA agreed with this recommendation and reported that it will explore options for updating one of its existing online courses--IS-368 "Including People with Disabilities and Other with Access and Functional Needs in Disaster Operations"--to tailor the content for a broader audience, including members of the public. The agency also reported that it will evaluate the need for alternative cost-effective methods for delivering other courses on inclusive emergency management it currently offers, such as its classroom course, "Integrating Access and Functional Need into Emergency Planning." The agency anticipates completing these efforts by December 31, 2017. When these efforts are complete, GAO will await documentation that the agency has evaluated its delivery of key training on incorporating access and functional needs into emergency planning.
    Recommendation: To help ensure its key training on incorporating access and functional needs into emergency planning reaches a sufficiently wide audience, the Secretary should direct the FEMA Administrator to collect information about the potential pool of participants, set general goals for the number of state and local emergency managers that will take this course, and implement the delivery methods needed to meet these goals.

    Comments: FEMA agreed with this recommendation and reported that it will work with its regional staff to map potential training participants in each state and set goals for delivery of the course to state and local emergency managers. The agency also reported that it may be able to use data in the State Preparedness Report and states' self-reporting on the need for training on integrating the needs of people with access and functional needs into emergency management. GAO will monitor the progress of these efforts. The agency anticipates completing these efforts by December 31, 2017.

    Recommendation: To help ensure that NNSA effectively manages the performance of its programs, the Secretary of Energy should establish a program management policy that (1) assigns responsibilities and delegates authority to program managers and establishes expectations of competence for them, in accordance with federal internal control standards, and (2) addresses leading program management practices, such as developing program plans.

    Comments: As of January 2017, DOE stated that it will address our recommendation as part of its effort to meet the requirements of the Program Management Improvement Accountability Act of 2016. This Act requires the Office of Management and Budget (OMB) to adopt government-wide standards, policies, and guidelines for program and project management for agencies. It also requires agencies to appoint program management improvement officers, establishes training competencies for program managers, and creates a job series and career path for program managers. According to the Act, OMB will issue the standards, policies, and guidelines required under the Act no later than December 14, 2017.
    Recommendation: To help ensure that NNSA develops and maintains a cadre of professional, effective, and capable program managers in accordance with leading program management practices and federal internal control standards, the Secretary of Energy should establish a training program for program managers.

    Recommendation: To help improve tribes' ability to maintain safe, stable, and permanent care for children, the Secretary of Health and Human Services should direct the Children's Bureau to explore the reasons for low tribal participation and identify actions to increase this participation in the title IV-E Guardianship Assistance Program.

    Comments: HHS agreed with this recommendation. The agency noted that some tribal-state agreements might predate 2008, when GAP was established. HHS also said that regional office staff participate annually in joint planning for the title IV-B and IV-E programs with their respective states and tribes and that participation in GAP is a topic covered in joint planning activities. In addition, HHS said that regional office staff are available to assist states and tribes with discussions about GAP participation when tribal-state agreements are renegotiated and that technical assistance is available to tribes, if needed. According to HHS, the agency plans to add information to the Children's Bureau website about direct federal funding for tribal title IV-E agencies and about tribal-state partnership agreements and plans to distribute issue briefs on GAP and best practices for tribal-state agreements. We agree that HHS has the planning process, technical assistance resources, and regional staff in place to discuss GAP participation with title IV-E state and tribal agency officials. However, our review found that tribal participation in GAP remains low, which suggests that HHS needs to identify actions to increase participation in this program. We believe that the additional actions HHS plans to take - providing information on the Children's Bureau website about direct funding and distributing issue briefs on GAP and best practices for tribal - state partnerships and agreements - could support tribes' participation in GAP either by helping tribes to directly operate a title IV-E program or to negotiate a tribal-state agreement that includes a provision for GAP participation. Because some tribes reported challenges at the state level to participating in GAP and several tribes reported that the state where they are located does not participate in the program, we encourage HHS to engage title IV-E state agency officials in discussions about tribal participation in GAP during the annual review of the their title IV-E state plan. HHS could identify ways that regional office staff might help state agencies resolve any challenges to GAP participation that tribes experience at the state level. HHS has taken several steps over the past few years to help tribes with their title IV-E programs, including hiring a tribal coordinator to facilitate communication between regional offices and tribal title IV-E agencies. Taking additional steps to ensure that tribes have the opportunity to participate in GAP could go a long way toward helping tribes gain more resources for children under their care and better support tribes' efforts to care for children exiting foster care to permanent homes.

    Recommendation: To more fully understand the food assistance needs that exist for active-duty servicemembers and their families, and to help ensure that DOD effectively targets its support to those in need of assistance, the Secretary of Defense should direct the Office of the Under Secretary of Defense for Personnel and Readiness to revise, as appropriate, any existing data-collection mechanisms, such as periodic surveys, to collect and analyze more complete data on the use of food assistance programs by servicemembers and their families and use the data to determine if any further actions are needed, such as assigning responsibilities at the department-level for monitoring the use of food assistance programs by active-duty servicemembers.

    Comments: As of August 2017, The Department of Defense (DOD) revised the questions on the September 2016 Status of Force Survey of Active Duty Members to include questions on whether servicemembers and their families had in the past 12 months run out of food, skipped meals, or were unable to eat balanced meals due to a lack of money. The survey also included questions on whether the servicemembers or their families had used food pantries in the past twelve months and asked the servicemembers to identify the factors that had contributed to their food concerns and/or need to use a food pantry. Finally, the survey included questions on the extent servicemember had ever applied for Supplemental Nutrition Assistance Program (SNAP) benefits (formerly known as the Food Stamp Program), whether they were currently receiving SNAP benefits, their paygrade at the time they first started receiving SNAP benefits, the total number of people in the household when they first started receiving SNAP benefits, and how long they have received SNAP benefits. DOD official stated that the results of the survey were not published until July 31, 2017 so they have not had the opportunity to review the results of the survey to determine what further actions, if any, are needed.
    Recommendation: To more fully understand the food assistance needs that exist for active-duty servicemembers and their families, and to help ensure that DOD effectively targets its support to those in need of assistance, the Secretary of Defense should direct the Office of the Under Secretary of Defense for Personnel and Readiness to coordinate with USDA to leverage its access to data on active-duty servicemembers and their families who use its programs and services and consider outreaching to other organizations that have data on servicemembers' use of food assistance.

    Recommendation: To enable a more effective approach in working with states to adopt the NDRF, the Secretary of Homeland Security should direct the Administrator of FEMA to conduct a systematic analysis of the information generated from FEMA's readiness assessments to determine the extent of regional office efforts to help states implement the NDRF, including conducting education and outreach.

    Comments: DHS concurred with this recommendation and said it would take steps to implement it. According to FEMA, its Office of Readiness Assessment (ORA) launched the 2016 bi-annual FEMA Readiness Assessment Program in April 2016, which includes NDRF related assessment discussions in five FEMA regions. We met with officials in April 2017, who told us that ORA plans to incorporate into this year's assessments, a retrospective review of NDRF findings and progress made in implementing the NDRF since 2013. We will continue to monitor this to see what additional actions the agency takes in response to this recommendation.
    Recommendation: To enable a more effective approach in working with states to adopt the NDRF, the Secretary of Homeland Security should direct the Administrator of FEMA to develop best practices and lessons learned with regard to conducting NDRF education and outreach to states based on the analysis of readiness assessments and create a mechanism to disseminate and share those best practices and lessons learned to FEMA regional offices.

    Comments: DHS concurred with this recommendation and said it would take steps to implement it. According to FEMA, its Recovery Support Function Leadership Group initiated an information management workgroup, which shares best practices information as one of its objectives. The workgroup has piloted the use of an existing interagency portal as a potential platform for improved information sharing. We met with officials in April 2017, who told us that FEMA will incorporate its 2016 readiness review findings and best practices from regional Federal Disaster Recovery Coordinators for stakeholder outreach and education into the final platform build-out. We will continue to monitor this to see what additional actions the agency takes in response to this recommendation.
    Recommendation: To enable a more effective approach in working with states to adopt the NDRF, the Secretary of Homeland Security should direct the Administrator of FEMA to clarify with regional offices and Federal Disaster Recovery Coordinators (FDRCs) the role of the regional implementation plans in FDRC performance plans and how they will be used to assess NDRF regional implementation efforts.

    Comments: DHS concurred with this recommendation and said it would take steps to implement it. According to FEMA, to achieve greater integration of FEMA's field leadership components, FEMA's Field Operations Directorate (FOD) convened a Field Leadership Working Group of senior subject matter experts to conduct a mission analysis of FEMA's Field Leadership function (which includes Federal Disaster Recovery Coordinators as well as Federal Coordinating Officers and Incident Management Assistance Teams team leads). According to FEMA, one of the assigned tasks of the group involves developing performance metrics to define a steady state and operational performance framework for field leaders, to include Federal Disaster Recovery Coordinators. According to FEMA, the Working Group is currently underway and is preparing a Field Leader Manual for review by FOD leadership. We will continue to monitor this to see what additional actions the agency takes in response to this recommendation.
    Recommendation: To enable a more effective approach in working with states to adopt the NDRF, the Secretary of Homeland Security should direct the Administrator of FEMA to align the annual FDRC performance expectations with clearly defined organizational goals and priorities, consistent with key management practices.

    Comments: DHS concurred with this recommendation and said it would take steps to implement it. According to FEMA, the Field Leadership Working Group will implement the elements of this recommendation alongside efforts to clarify the role of the regional National Disaster Recovery Framework implementation plans. FEMA also provided documentation to GAO noting that the Working Group is progressing in its work on its Field Leadership Professional Development Plan. We will continue to monitor this to see what additional actions the agency takes in response to this recommendation.

    Recommendation: To help foster and unaccompanied homeless youth better navigate the college admissions and federal student aid processes, the Secretaries of Education and HHS should jointly study potential options for encouraging and enabling child welfare caseworkers, McKinney-Vento homeless youth liaisons, and other adults who work with these youth to more actively assist them with college planning.

    Comments: Education, working with the Department of Health and Human Services, issued a Foster Youth Transition Toolkit in May 2016 which addresses both financial aid and college admissions processes. The toolkit was written for youth in or formerly in foster care rather than for professionals who serve these youth. Education noted that it had also posted a Homeless Youth Fact sheet for teachers and other professionals on its website in July. Education said that it will continue to work with HHS and the National Association for the Education of Homeless Children and Youth about college admissions and federal student aid processes for foster and unaccompanied homeless youth. Education also plans to conduct a technical assistance webinar for McKinney-Vento homeless youth liaisons and to provide technical assistance for other programs. Making such information available on Education's website is an encouraging step, as are plans to conduct webinars for professionals who work with homeless youth. We look forward to the implementation of these plans. However, we continue to believe that HHS and Education should consider ways to encourage more active college planning efforts among professionals who work with homeless and foster youth that consider professional staff's competing goals and priorities and multiple responsibilities.
    Recommendation: To help foster and unaccompanied homeless youth better navigate the college admissions and federal student aid processes, the Secretaries of Education and HHS should jointly study potential options for encouraging and enabling child welfare caseworkers, McKinney-Vento homeless youth liaisons, and other adults who work with these youth to more actively assist them with college planning.

    Comments: HHS, working with the Department of Education, issued a Foster Youth Transition Toolkit in May 2016 which encourages current and former foster youth to pursue college and addresses both financial aid and college admissions processes. The toolkit was written for youth in or formerly in foster care, and HHS considers it a resource for unaccompanied homeless youth as well as for the adults who serve these youth. Making such information available through this joint publication is an encouraging step. However, child welfare caseworkers, school homelessness liaisons, and other professionals who work with homeless and foster youth have competing goals and priorities and multiple responsibilities. To encourage and facilitate college planning and admissions efforts, Education and HHS would need to carefully consider professional staff's workloads, responsibilities, and training needs, among other issues, and develop some options for encouraging college planning efforts among professionals in these programs who work with homeless and foster youth.
    Recommendation: To help foster and unaccompanied homeless youth, as well as adults who assist these youth, better navigate the federal student aid process and obtain information about college resources, the Secretary of Education, in consultation with the Secretary of HHS, should create webpages directed to homeless and foster youth so they can more easily find tailored and centralized information about available federal and other resources, such as Pell Grants, Chafee Education and Training Voucher Program (Chafee ETV Vouchers), and waivers for college admission tests.

    Comments: In addition to having a webpage about foster youth, Education noted that in April 2016 it had created a new webpage with resources for homeless children and youth. In July 2016, Education developed and posted online a Foster Care Transition Toolkit and a Fact Sheet on federal student aid for homeless youth that is available through its resources webpage. The development and posting of these materials on the agency's website offers helpful resources to foster and homeless youth; however, Education should also make it easier for these youth, who often lack adult support, to find these documents easily--such as by referring to them on the page that says who is eligible for federal student aid--without lengthy searching of the Website.
    Recommendation: To help college financial aid administrators more effectively implement eligibility rules for unaccompanied homeless youth, the Secretary of Education should make available an optional worksheet or form that college financial aid administrators can voluntarily use to document unaccompanied homeless youth status or encourage the use of existing forms that are available.

    Status: Open

    Comments: Education agreed that it would be helpful to make forms developed by outside organizations knowledgeable about homelessness issues available for financial aid administrators to use for documenting the status of unaccompanied homeless youth. Education also said that it plans to highlight the availability of these forms and provide guidance at its annual conference and in updates to the Federal Student Aid Handbook. Education noted that it will not endorse the use of a specific form but that it will highlight forms that already exist that may be useful to financial aid administrators. We look forward to Education making such forms available for college financial aid administrators so that they can more effectively implement eligibility rules for unaccompanied homeless youth.
    Recommendation: To help homeless youth more easily access federal student aid, the Secretary of Education should clarify its guidance to financial aid administrators and students about whether financial aid administrators should accept any unaccompanied homeless youth determination provided by McKinney-Vento homeless liaisons or other authorized officials even if a student is not in high school or receiving program services.

    Comments: In June 2016, Education posted questions and answers about federal student for homeless youth on its website and in July, the agency posted a fact sheet about Homeless Youth on its webpage for teachers and other professional staff. However, neither document states whether financial aid administrators should accept any unaccompanied homeless youth determination provided by McKinney-Vento liaisons or authorized officials even if a student is not in high school or receiving program services. In July 2016, Education issued guidance for the McKinney-Vento program specifying that a local liaison may continue to provide verification of a youth's homelessness status for federal student aid purposes for as long as the liaison has access to the information necessary to make such a determination for a particular youth. The guidance also stated that local homelessness liaisons should ensure that all homeless high school students receive information and counseling on college-related issues. Education said that it will also hold a technical assistance webinar for McKinney-Vento Education for Homeless Children and Youths Program liaisons. In July 2016, Education said that it will issue the most-up-to-date guidance clarifying that financial aid administrators should accept any unaccompanied homeless youth determination provided by McKinney-Vento liaisons or authorized officials even if a student is not in high school or receiving program services. In addition to updating its guidance for financial aid administrators, the agency should also update the question and answer factsheet on federal student aid for homeless students and the factsheet for professionals so that the information on unaccompanied homeless youth determinations is presented consistently in these key documents.
    Recommendation: To enhance access to federal student aid for unaccompanied homeless youth, the Secretary of Education should consider developing a legislative proposal for congressional action to simplify the application process so that once a student has received an initial determination as an unaccompanied homeless youth, the student will not be required to have that status re-verified in subsequent years but attest to their current status on the Free Application for Federal Student Aid, unless a financial aid administrator has conflicting information.

    Comments: In July 2016, Education said that the department had proposed further simplification of the FAFSA in its fiscal year 2017 budget proposal. Education stated that it will also consider the feasibility of a legislative proposal to not require re-verification of homelessness after a student has received an initial determination. Such a legislative proposal would enhance access to federal student aid for unaccompanied homeless youth.
    Recommendation: To simplify program rules for Chafee ETV vouchers and improve access to these vouchers for former foster youth ages 21 and 22, the Secretary of HHS should consider developing a legislative proposal for congressional action to allow foster youth to be eligible for the Chafee ETV voucher until age 23 without also requiring that they start using the voucher before they turn 21.

    Comments: HHS's budget request for fiscal year 2018 does not contain a legislative proposal to improve access to Chafee vouchers for former foster youth ages 21 and 22. In July 2016, HHS noted that it had made a proposal for mandatory programs to improve foster youth's access to vouchers for title IV-E Chafee programs in the Administration for Children and Families' fiscal year 2017 budget request. However, the agency explained that the proposal's purpose is to extend eligibility for Chafee Foster Care Independence Program (CFCIP) services to youth up to age 23 in jurisdictions that have extended foster care to age 21. According to HHS, the budgetary proposal does not affect the Chafee Vouchers. A legislative proposal to simplify program rules for Chafee ETV vouchers would support improving access to these vouchers for former foster youth ages 21 and 22.

Education also noted that borrowers can use interactive voice response and web technology to access information from their servicers during periods when live operators are not available. While these are additional tools for borrowers, they do not replace the need for access to live representatives, and, as we note in the report, Education's customer satisfaction surveys of borrowers in 2014 and 2015 raised concerns about the usefulness of servicers' automated voice response systems. Establishing core call center hours in servicer requirements, if implemented as Education described, would meet the intent of the recommendation.

In addition, the agency reported that it will establish a common borrower experience and common branding in the requirements for the ongoing student loan servicing solicitation by, among other things, requiring the creation of a single web portal clearly labeled as representing the agency. Through that system, all borrowers will be ale to access information, make payments, apply for benefits and manage their accounts. When implemented, this new platform, in conjunction with FSA's Feedback System, will collect complaint information at FSA comprehensively.

The Helping Families in Mental Health Crisis Reform Act of 2016 enacted in December 2016 included a requirement for HHS to develop a strategy for conducting ongoing evaluations of programs related to mental illness--including serious mental illness--and substance use disorders. As of August 2017, HHS is in the process of preparing a report that identifies key programs and activities across the department, as well as summarizes data on those programs and develops criteria for use in prioritizing programs for evaluation. However, this report is not yet complete. We will continue to monitor HHS's efforts in this regard and look for documentation of HHS plans for future evaluations of programs for individuals with serious mental illness.

    Recommendation: To better ensure servicemember participation in and completion of TAP, the Secretary of Defense should direct the Under Secretary for Personnel and Readiness to require that all services provide unit commanders and their leaders information on TAP participation levels of servicemembers under their command, similar to that provided by the Army and Air Force. Such information could be used to help hold leaders accountable for ensuring TAP participation and completion.

    Comments: DOD disagreed with this recommendation and, as of January 2016, has not taken action to address it. In its written comments published in GAO's 2014 report, DOD questioned GAO's concern that not having a mechanism to ensure a servicemember's completion of TAP by commander would result in commanders not supporting the release of servicemembers to attend TAP. DOD noted that GAO's concern is based on observations that preceded full implementation of the capstone event. In October 2013, DOD launched the capstone as a mandatory process by which commanders verify TAP participation and positively affirm that servicemembers have or have not met career readiness standards. In addition, DOD said that capstone event implementation was accompanied by a communications campaign to inform both commanders and the services. Finally, DOD said that capstone event completion is monitored departmentwide to ensure compliance. However, GAO believes that such monitoring does not provide routine information to commanders and their leaders and not all TAP locations will be monitored routinely. GAO's report noted that DOD reported that ensuring servicemember participation in capstone events was a challenge for most of the services possibly due, in part, to lack of commanders' support. Commander support for the program has been a long-standing challenge for the program. Therefore, we continue to believe that an accountability mechanism is needed for TAP that mirrors the level at which responsibility has been assigned. Since commanders are responsible for ensuring that eligible servicemembers have full access to and successfully complete required TAP components, providing them and their leaders information on TAP participation levels of servicemembers under their command could promote accountability and oversight. Servicemember participation in TAP is generally required by law and DOD policy, and also relates to a Cross-Agency Priority Goal, reinforcing the need for such a mechanism. For GAO to close this recommendation, DOD should require all services to provide unit commanders and their leaders information on TAP participation levels of servicemembers under their command.
    Recommendation: To provide information on the extent to which the revamped TAP is effective, the Secretary of Defense should direct the Under Secretary for Personnel and Readiness to work with the partner agencies to develop a written strategy for determining which components and tracks to evaluate and the most appropriate evaluation methods. This strategy should include a plan to use the results of evaluations to modify or redesign the program, as appropriate.

    Comments: DOD has partially addressed GAO's recommendation on evaluating the effectiveness of the revamped TAP, information that is currently limited. DOD's May 2014 presentation to OMB on the status of TAP implementation and evaluation efforts lists specific TAP components and tracks in which VA, DOL, and SBA planned to assess TAP effectiveness or post-transition outcomes. Although the presentation to OMB indicated that VA planned a higher level evaluation, as of December 2015, VA officials said they are focusing on lower level evaluations, such as gauging participant reactions to training and monitoring. As of March 2016, DOL has been conducting a quasi-experimental evaluation of the Employment Workshop, which it expects to complete in 2017. Further, SBA officials said they are surveying Entrepreneurial track participants who agreed to a post-TAP, follow-up survey. However, DOD and the agencies have not fully demonstrated a strategic approach to planning higher level evaluations. Specifically, DOD and its partner agencies have not provided a rationale for why they chose to evaluate certain aspects of TAP and not others. A written rationale, along with how the agencies plan to use the results of the evaluations, is required for GAO to consider this recommendation closed.

    Recommendation: To provide the basis for greater consistency across states in assessing elder justice service delivery, the Secretary of HHS, as chairman of the Elder Justice Coordinating Council, should direct the Council to make it a priority to identify common objectives for the federal elder justice effort and define common outcomes.

    Comments: HHS agreed with this recommendation and noted the formation of the Elder Justice Coordinating Council (EJCC) as an effort to develop common objectives and plans for action to address elder justice issues. As of June 2014, the EJCC had developed eight recommendations for increased federal leadership in combating elder abuse based on input from elder justice experts in financial exploitation, public policy and awareness, enhancing response, and advancing research. Staff compiled information on best and promising practices for primary, secondary, and tertiary prevention; empirical evidence from peer-reviewed research; approaches used in related disciplines; and information about where gaps exist in the collective knowledge about elder abuse, neglect and exploitation. Staff then turned the suggestions into proposals with accompanying steps for federal action. Those proposals were subsequently presented at two public EJCC meetings (May and September 2013) and were made available for public review and comment. The Secretary of HHS formally accepted the recommendations in May 2014, and they were posted to the EJCC page of the Administration on Aging's website. In May 2015, HHS reported that the EJCC had published these recommendations in a document entitled "Eight (8)Recommendations for Increased Federal Involvement in Addressing Elder Abuse, Neglect, and Exploitation" and stated that the recommendations addressed the issues identified in GAO's recommendation. While we recognized that these 8 recommendations corresponded to the common objectives included in our recommendation, we also sought from HHS information on the status of common outcomes for the objectives. HHS reported that outcomes for the eight common objectives that the EJCC has approved were being discussed, but have not yet been approved. In March 2016,HHS reported that the EJCC's Elder Justice Working Group continued to gather and discuss action steps and outcomes for the eight recommendations. We will monitor the EJCC's progress in agreeing upon outcomes and close the recommendation when agreement on outcomes is reported.

    Recommendation: To increase the efficiency and effectiveness of the process for disaster declarations, the FEMA Administrator should develop and implement a methodology that provides a more comprehensive assessment of a jurisdiction's capability to respond to and recover from a disaster without federal assistance. This should include one or more measures of a jurisdiction's fiscal capacity, such as TTR, and consideration of the jurisdiction's response and recovery capabilities. If FEMA continues to use the PA per capita indicator to assist in identifying a jurisdiction's capabilities to respond to and recover from a disaster, it should adjust the indicator to accurately reflect the annual changes in the U.S. economy since 1986, when the current indicator was first adopted for use. In addition, implementing the adjustment by raising the indicator in steps over several years would give jurisdictions more time to plan for and adjust to the change.

    Comments: On January 20, 2016, FEMA published an Advanced Notice of Proposed Rulemaking to solicit comments on an option FEMA is considering to establish a disaster deductible, which would require a predetermined level of financial or other commitment from a recipient, generally the state or territorial government, before FEMA would provide assistance under the Public Assistance Program. According to FEMA, the agency received 150 responses during the 60-day public comment period, which ended on March 21, 2016, and used this input to develop a plan for further engagement on a more detailed proposal for public comment. The Supplemental Advanced Notice of Proposed Rulemaking, published on January 12, 2017, provided another opportunity for stakeholder input prior to any changes to the Public Assistance program. This proposal included an explanation of how deductible amounts might be calculated, identified specific credits that states could apply for, and detailed how the deductible would be applied post-declaration. Comments on the Supplemental Advanced Notice of Proposed Rulemaking must be submitted by April 12, 2017. Until FEMA implements a new methodology, FEMA will not have an accurate assessment of a jurisdiction's capabilities to respond to and recover from a disaster without federal assistance and runs the risk of recommending that the President award Public Assistance to jurisdictions that have the capability to respond and recover on their own.

In addition, EPA noted in May 2015 that the agency did not have any mentor-protege agreements in place and thus no need to develop and implement a systemic methodology for tracking program results. EPA added that it anticipates taking steps necessary to implement program tracking in accordance with SBA's revised mentor-protege guidance once it is finalized.

    Recommendation: To the extent that the CDBG program continues to be the primary vehicle used to provide post-disaster assistance for permanent housing, Congress may wish to consider providing more specific direction regarding the distribution of disaster-related CDBG assistance that states are to provide for homeowners and renters. If Congress wishes to change the proportion of assistance directed to homeowners and rental property owners in future recovery efforts, Congress could, for example, require states to demonstrate to HUD that they are adequately addressing the needs of both homeowners and renters with their CDBG allocation and other resources as a condition for receiving funds. Alternatively, Congress could direct HUD to develop a formula that accounts for the housing needs of both homeowners and renters. Such a formula could be used by states to determine the proportions of their disaster CDBG funds that should be used for housing, specifically rental housing. Further, the formula could also reflect the anticipated production levels of other programs that provide permanent housing assistance, such as the Low-Income Housing Tax Credit program.

    Comments: Since the Gulf Coast hurricanes, Congress appropriated CDBG Disaster Funding for subsequent disasters, including $16 billion to assist recovery in areas affected by Hurricane Sandy and other eligible events in calendar years 2011, 2012, and 2013. According to Pub. L. No. 113-2, Congress did not require states to demonstrate to HUD that they were adequately addressing the needs of both homeowners and renters. Moreover, Congress does not appear to have directed HUD to develop a formula that accounts for the housing needs of both homeowners and renters. As of January 2017, no CDBG appropriations for disaster relief have addressed this issue.

    Recommendation: Given the critical importance of telecommunications technologies to schools and libraries, the Chairman of the Federal Communications Commission should direct FCC staff to establish performance goals and measures for the E-rate program that are consistent with the Government Performance and Results Act. FCC should use the resulting performance data to develop analyses of the actual impact of E-rate funding and to determine areas for improved program operations.

    Comments: In an August 2007 order, FCC adopted two performance measures for the E-rate program, one for Internet connectivity and the other for application processing. The order did not include specific E-rate program goals, although FCC said in this order that it anticipated adopting performance goals as it and USAC gained experience with the performance measures. While FCC's efforts to develop performance measures have the potential to eventually produce better information than is currently available on E-rate program performance, these measures fall short when compared to the key characteristics of successful performance measures and FCC still has not established program goals. FCC says it is still working on developing goals and performance measures for the Universal Service programs.
