    Recommendation: To provide more reliable information for assessing the progress of its cost containment efforts and for informing judiciary and congressional oversight and decision making, the Director of AOUSC should develop a reliable method for estimating cost savings achieved (i.e., that ensures that cost savings are calculated in an accurate and complete manner) for major cost containment initiatives (as determined by the judiciary).

    Comments: In September 2016, the AOUSC reported that the Judicial Conference Budget Committee (Committee) discussed the GAO report and its two recommendations relating to major cost containment initiatives in January 2016. Among other things, the Budget Committee asked AOUSC staff to lead a working group to examine major cost containment efforts and develop recommendations on how to proceed on improvements to the calculation and reporting of associated cost savings. According to the AOUSC, work is currently underway to address the Budget Committee's recommendations. To fully address this recommendation, the AOUSC should provide the working group's recommendations on how to proceed on improvements to the calculation of cost savings associated with major cost containment efforts and evidence that the improvements have been implemented.
    Recommendation: To provide more reliable information for assessing the progress of its cost containment efforts and for informing judiciary and congressional oversight and decision making, the Director of AOUSC should regularly report estimated cost savings achieved for major cost containment initiatives (as determined by the judiciary).

The AOUSC stated that the Committee believes that reporting on the Judiciary's cost containment initiatives should be included in the Judiciary's annual budget justification materials, as appropriate, to support the annual budget request. To fully address this recommendation, the AOUSC should provide the working group's recommendations on how to proceed on improvements to the reporting of cost savings associated with major cost containment efforts and evidence that the improvements have been implemented.

    Recommendation: When planning for the next phase of national security space launches, Phase 2, the Secretary of the Air Force should consider using an incremental approach to the next launch services acquisition strategy. Planning for acquisitions on a short term basis will help ensure that the Air Force does not commit itself to a strategy until the appropriate amount of data is available to make an informed decision, and will allow for flexibility in responding to a changing launch industry.

    Comments: In providing comments on this report, the agency concurred with this recommendation but has not yet completed actions necessary to implement it. The acquisition strategy for the next phase of national security launches, Phase 2, has not yet been finalized by the Air Force. The EELV program office expects it to be completed in the summer of 2018.

    Recommendation: To help the Department of Health and Human Services better control spending and encourage efficient delivery of care, Congress should consider requiring Medicare to pay PCHs as it pays PPS teaching hospitals, or provide the Secretary with the authority to otherwise modify how Medicare pays PCHs. To generate cost savings from any reduction in outpatient payments to PCHs, Congress should also provide that all forgone outpatient payment adjustment amounts be returned to the Supplementary Medical Insurance Trust Fund.

    Comments: The 21st Century Cures Act enacted in December 2016 slightly reduces the additional payments to PCHs for outpatient services furnished on or after January 1, 2018, and returns savings to the Supplementary Medical Insurance Trust Fund. However, the law does not substantively change how PCHs are paid for outpatient services, which differs from how Medicare pays PPS teaching hospitals. In addition, as of March 1, 2017, no legislative action had been identified that changes how PCHs are paid for inpatient services, as GAO suggested in February 2015. Until Medicare pays these cancer hospitals in a way that encourages greater efficiency, Medicare remains at risk for overspending.
