Pursuant to a congressional request, GAO discussed its recent studies of federal agencies' attempts to use the Unified Agenda of Federal Regulatory and Deregulatory Actions to satisfy the notification requirements of the Regulatory Flexibility Act (RFA) of 1980.

| Regulatory Information Service Center | The Executive Director, Regulatory Information Service Center, in consultation with the Office of Information and Regulatory Affairs and other agencies, should ensure that entries characterized as section 610 reviews in future editions of the Unified Agenda meet the requirements of the RFA. |
The Regulatory Information Service Center contacted agencies with section 610 entries in the Unified Agenda and encouraged them to improve their compliance with the statute. Although some agencies indicated that they would do so, other agencies said that they disagreed with GAO's interpretation of the statute. The Center recently changed the form agencies submit to differentiate between upcoming/ongoing reviews and reviews that are completed and is continuing to work with the agencies. However, the Center does not review each entry for compliance with the Act before including it in the Agenda.
