President's Second Special Message for Fiscal Year 1987

GAO reviewed the President's second special message for fiscal year (FY) 1987.
GAO noted that, after the President submitted his message, the U.S. Court of Appeals for the District of Columbia held that: (1) the portion of the Impoundment Control Act of 1974 dealing with policy deferrals was unconstitutional; and (2) the programmatic deferral authority granted under the Antideficiency Act was valid. GAO held that, since all of the impoundments in the message relied on the Antideficiency Act, they were correctly authorized. GAO found no reason to question the deferrals' legality, since they were in accordance with existing law.
