A review was made of the effects on small employers of Rule 91a which defined the grounds and procedures for filing a petition for discretionary review of an Occupational Safety and Health Review Commission administrative law judge's decision. Results indicated that the rule has not significantly hurt small businesses either before or after the rule was implemented; few positions for review were denied after implementation of the rule; and Commission review usually did not change the employer's status.
