GAO reviewed the Department of Defense (DoD), Office of the Secretary's new rule on the relationship between the TRICARE Program and employer-sponsored group health coverage. GAO found that (1) this law prohibits employers from offering incentives to TRICARE-eligible employees to not enroll or to terminate enrollment in an employer-offered Group Health Plan (GHP) that is or would be primary to TRICARE, in the same manner as employers are prohibited from offering incentives to Medicare-eligible employees; and (2) DoD complied with the applicable requirements in promulgating the rule.
