GAO reviewed the the Department of Health and Human Services, Centers for Medicare and Medicaid Services' (CMS) new rule on immunization standards for long term care facilities. GAO found that (1) the rule requires long term care facilities to offer each resident immunization against influenza annually, as well as lifetime immunization against pneumococcal disease, and the facilities will be required to ensure that before offering the immunizations, each resident or the resident's legal representative receives education regarding the benefits and potential side effects of immunizations; and (2) with the exception of the 60-day delay in the effective date, CMS complied with applicable requirements in promulgating the rule.
