GAO reviewed the Centers for Medicare and Medicaid Service's (CMS) new rule on changes to Medicare claims appeal procedures. GAO found that (1) the rule implements the changes to the Medicare claims appeal procedures by section 521 of the Medicare, Medicaid, and SCHIP Benefits Act of 2000 and provides for implementing the new statutory requirements enacted in Title IX of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003; and (2) with the exception of the 60-day delay in the effective date, CMS complied with the applicable requirements in promulgating the rule.
