GAO reviewed the Department of Health and Human Services, Centers for Medicare and Medicaid Services' (CMS) new rule on changes to the criteria for being classified as an inpatient rehabilitation facility in the Medicare Program. GAO found that (1) the rule would revise the classification criterion, commonly known as the "75 percent rule," used to classify a hospital as an inpatient rehabilitation facility; and (2) with the exception of the 60-day delay in the effective date, CMS complied with all applicable requirements in promulgating the rule.
