THERE WAS RECEIVED BY THIRD INDORSEMENT DATED MAY 10, 1950, FROM THE CHIEF OF FINANCE, YOUR LETTER OF APRIL 4, 1950, TRANSMITTING FOR AN ADVANCE DECISION SUPPLEMENTAL ARMORY DRILL PAYROLL OF HEADQUARTERS AND HEADQUARTERS COMPANY, 168TH INFANTRY REGIMENT, IOWA NATIONAL GUARD, FOR THE PERIOD FROM AUGUST 1, 1948, TO SEPTEMBER 30, 1948, IN FAVOR OF WARREN E. MONDT, FIRST LIEUTENANT, COVERING FLYING PAY EARNED DURING THE PERIOD INVOLVED.

YOUR DOUBT IN THE MATTER, AS EXPRESSED IN YOUR LETTER, IS DUE TO THE FACT THAT THE CLAIM FOR ADDITIONAL FLIGHT PAY IS BASED ON A CORRECTED SCHEDULE OF FLIGHTS-- THE CERTIFIED SCHEDULE OF FLIGHTS SUBMITTED WITH THE ORIGINAL ARMORY DRILL PAYROLL FOR THE SAME PERIOD NOT INCLUDING FLIGHTS FOR THE MONTH OF SEPTEMBER 1948.

THE SAID ORIGINAL PAYROLL (VOUCHER NO. 29153 OF THE NOVEMBER 1948 ACCOUNT OF COLONEL J. H. DOHERTY, F.D.) CONTAINS ENTRIES SHOWING THAT LIEUTENANT MONDT WAS FEDERALLY RECOGNIZED ON MAY 12, 1948; THAT HE SATISFACTORILY PERFORMED APPROPRIATE DUTIES ON AUGUST 3 AND 31, AND SEPTEMBER 7, 14, AND 21, 1948-- A TOTAL OF FIVE PERIODS OF APPROPRIATE DUTY; THAT HE HAD COMPLETED OVER 10 YEARS' SERVICE; THAT HE WAS ENTITLED TO FLIGHT PAY; THAT HE WAS PAID $44.08, REPRESENTING ARMORY DRILL PAY AS WITH OVER 10 YEARS' SERVICE FOR THE FIVE DRILLS INVOLVED; AND THAT HE WAS NOT CREDITED WITH OR PAID FLYING PAY BASED ON SUCH DRILLS.

ATTACHED TO THE SAID ORIGINAL PAYROLL IS A "SCHEDULE OF FLIGHTS" SHOWING THAT DURING THE PERIOD FROM AUGUST 11, 1948, TO AUGUST 22, 1948, INCLUSIVE, THE OFFICER PERFORMED A TOTAL OF 19 FLIGHTS (1,230 MINUTES) DURING THE PERIOD FROM MAY 12, 1948, TO JULY 11, 1948, INCLUSIVE. THE SAID FLIGHT SCHEDULE IS SUPPORTED BY A COPY OF A LETTER (CSMGB) DATED AUGUST 11, 1948, ADDRESSED TO LIEUTENANT MONDT, AS FOLLOWS:

"PURSUANT TO AUTHORITY CONTAINED IN MGB CIRCULAR NO. 28, 16 JULY 1947, FIRST LIEUTENANT WARREN E. MONDT, 0758834, HAVING BEEN GRANTED THE AERONAUTICAL RATING OF LIAISON PILOT, IS REQUIRED TO PARTICIPATE REGULARLY AND FREQUENTLY IN AERIAL FLIGHTS EFFECTIVE THIS DATE FOR A PERIOD OF ONE YEAR UNLESS SOONER RESCINDED."

ATTACHED TO THE SUPPLEMENTAL PAYROLL SUBMITTED WITH YOUR LETTER IS A COPY OF THE CSNGB LETTER OF AUGUST 11, 1948, QUOTED ABOVE, SUPPORTED BY AN ADDITIONAL "SCHEDULE OF FLIGHTS" WHICH SHOWS THAT THE OFFICER PERFORMED A TOTAL OF FOUR FLIGHTS (130 MINUTES) DURING THE PERIOD FROM SEPTEMBER 5 TO 26, 1948, INCLUSIVE. THERE IS SUBMITTED, ALSO, A CERTIFICATE OF THE COMMANDING OFFICER OF THE ORGANIZATION STATING THAT THE FLIGHT SCHEDULE SUBMITTED WITH THE ORIGINAL ARMORY DRILL PAYROLL ERRONEOUSLY OMITTED FLIGHTS PERFORMED DURING THE MONTH OF SEPTEMBER 1946. THE TOTAL NUMBER OF FLIGHTS PERFORMED DURING THE PERIOD FROM AUGUST 11, 1948 (DATE OF ORDERS TO FLIGHT DUTY), TO SEPTEMBER 30, 1948, EXCEEDS THE MINIMUM REGULATION REQUIREMENTS FOR THAT PERIOD.

THE OFFICIAL RECORDS-- ORDERS OF AUGUST 11, 1948; FLIGHT SCHEDULES ATTACHED TO THE ORIGINAL AND SUPPLEMENTAL PAYROLLS; AND THE COMMANDING OFFICER'S CERTIFICATE-- INDICATE THAT THE OMISSION FROM THE ORIGINAL FLIGHT SCHEDULE OF THE FLIGHTS PERFORMED IN SEPTEMBER 1948 WAS A CLERICAL OVERSIGHT (THE ORIGINAL PAYROLL CONTAINING, AS STATED ABOVE, A REMARK INDICATING THAT FLIGHT PAY WAS DUE) AND, INASMUCH AS THE ORGANIZATION INVOLVED-- A NON-FLYING ORGANIZATION-- HAD NO OTHER PERSONNEL IN A FLYING STATUS, IT APPEARS THAT HAD THE COMPLETE SCHEDULE OF THE FLIGHTS OF RECORD BEEN MADE AVAILABLE WHEN THE ORIGINAL PAYROLL WAS IN COURSE OF PREPARATION, PAYMENT OF FLYING PAY WOULD HAVE BEEN MADE ON THE SAID ORIGINAL ROLL.

THERE BEING AN OFFICIAL RECORD THAT THE FLIGHTS WERE ACTUALLY PERFORMED BY A DULY QUALIFIED OFFICER PROPERLY ORDERED TO SUCH DUTY, PAYMENT ON THE SUPPLEMENTAL ARMORY DRILL PAYROLL, RETURNED HEREWITH, TOGETHER WITH THE OTHER PAPERS SUBMITTED WITH YOUR LETTER, IS AUTHORIZED UPON EXTENSION IN THE AMOUNT DUE, IF THE SAID PAYROLL IS OTHERWISE CORRECT. NO FLYING PAY IS DUE FOR THE APPROPRIATE DUTY PERIOD (DRILL) HELD ON AUGUST 3, 1948, PRIOR TO THE ORDERS DATED AUGUST 11, 1948.
