REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 7, 1949, TRANSMITTING A REIMBURSEMENT VOUCHER FOR $4.38 IN FAVOR OF GROVER F. BROWN, REPRESENTING ADDITIONAL PER DIEM ALLOWANCE CLAIMED INCIDENT TO AIR TRAVEL PERFORMED BY HIM BETWEEN WASHINGTON, D.C., AND LONDON, ENGLAND, AS AN EMPLOYEE OF THE DEPARTMENT OF AGRICULTURE, AND REQUESTING A DECISION WHETHER THE VOUCHER PROPERLY MAY BE CERTIFIED FOR PAYMENT.

SO FAR AS IS HERE PERTINENT, THE TRAVEL ORDER, AS AMENDED, AUTHORIZED PER DIEM ALLOWANCES OF $8.40 IN THE UNITED STATES, $10 IN LONDON, AND $6 "FOR TRAVEL BY AIR INVOLVING AREAS FOR WHICH DIFFERENT MAXIMUM PER DIEM RATES ARE PRESCRIBED, INCLUDING STOPOVERS INVOLVING LESS THAN SIX URS.' THE QUOTED WORDING OF THE ORDER WITH RESPECT TO AIR TRAVEL IS IDENTICAL WITH THAT OF PARAGRAPH 45 OF THE STANDARDIZED GOVERNMENT TRAVEL REGULATIONS AS AMENDED BY BUREAU OF THE BUDGET CIRCULAR NO. A-7 OF JUNE 29, 1949. IT IS UNDERSTOOD THAT MR. BROWN TRAVELED BY AIR FROM WASHINGTON, D.C., TO LONDON, AND RETURN, VIA IRELAND, WITH STOPOVERS AT NEW YORK, AND IT IS ASSUMED THAT NEITHER OF THE SAID STOPOVERS EQUALED OR EXCEEDED SIX HOURS IN DURATION.

THE AIR TRAVEL UNDER CONSIDERATION INVOLVED AREAS FOR WHICH DIFFERENT MAXIMUM PER DIEM RATES ARE PRESCRIBED, THAT IS, $9 IN THE UNITED STATES, AND $10 IN LONDON, ENGLAND. UNDER THE TRAVEL REGULATIONS REFERRED TO $6 PER DIEM IS THE MAXIMUM RATE AUTHORIZED BY LAW FOR SUCH TRAVEL. THE FACT THAT THE POINT OF DEPARTURE WAS LOCATED WITHIN THE LIMITS OF THE CONTINENTAL UNITED STATES DID NOT OPERATE TO PLACE THE TRAVEL PERFORMED BY THE CLAIMANT OUTSIDE THE SCOPE OF THE REGULATORY PROVISION HERE INVOLVED.

UNDER THE CIRCUMSTANCES, THE VOUCHER, WHICH IS RETURNED HEREWITH, PROPERLY MAY NOT BE CERTIFIED FOR PAYMENT.
