TO THE SECRETARY OF THE ARMY: REFERENCE IS MADE TO LETTER DATED NOVEMBER 26. THE PAYMENTS WERE QUESTIONED IN A REPORT OF INVESTIGATION TRANSMITTED TO YOU WITH OUR LETTER OF JANUARY 16. A FURTHER INVESTIGATION WAS MADE AND THE FACTS AND INFORMATION DEVELOPED ARE SET FORTH IN A SUPPLEMENTAL REPORT OF INVESTIGATION. - COPIES OF WHICH ARE ENCLOSED. - THE FATHER'S INCOME FROM EMPLOYMENT WAS MORE THAN THE STATED AVERAGE MONTHLY LIVING EXPENSES OF THE MOTHER AND FATHER. - THAT THE MOTHER WAS NOT IN FACT DEPENDENT ON THE OFFICER FOR HER CHIEF SUPPORT DURING THOSE PERIODS. IS FOR DETERMINATION BY YOUR DEPARTMENT. IT IS REQUESTED THAT THE DEPARTMENT OF THE ARMY TAKE ALL NECESSARY STEPS TO RECOVER SUCH IMPROPER PAYMENTS AS WERE MADE TO THE OFFICER.

REFERENCE IS MADE TO LETTER DATED NOVEMBER 26, 1952, WITH ENCLOSURES, FROM THE CHIEF OF FINANCE, FILE FINEI 245.81 HASTEY, ANN G., K-779050, CONCERNING PAYMENTS OF RENTAL AND SUBSISTENCE ALLOWANCES MADE TO FIRST LIEUTENANT ANN G. HASTEY, AMC, AS AN OFFICER WITH A DEPENDENT MOTHER DURING THE PERIODS FROM JULY 10, 1944, THROUGH DECEMBER 1, 1945, AND FROM NOVEMBER 1, 1948, THROUGH DECEMBER 31, 1950. THE PAYMENTS WERE QUESTIONED IN A REPORT OF INVESTIGATION TRANSMITTED TO YOU WITH OUR LETTER OF JANUARY 16, 1952, I-17000-1614.

AFTER RECEIPT OF THE LETTER OF NOVEMBER 26, 1952, A FURTHER INVESTIGATION WAS MADE AND THE FACTS AND INFORMATION DEVELOPED ARE SET FORTH IN A SUPPLEMENTAL REPORT OF INVESTIGATION--- I-17000-3102--- COPIES OF WHICH ARE ENCLOSED. THE RECORD SHOWS THAT--- DURING THE PERIODS IN QUESTION--- THE FATHER'S INCOME FROM EMPLOYMENT WAS MORE THAN THE STATED AVERAGE MONTHLY LIVING EXPENSES OF THE MOTHER AND FATHER. IT THUS APPEARS--- ON THE BASIS OF THE FAMILY UNIT RULE--- THAT THE MOTHER WAS NOT IN FACT DEPENDENT ON THE OFFICER FOR HER CHIEF SUPPORT DURING THOSE PERIODS, REGARDLESS OF THE AVERAGE MONTHLY AMOUNT OF THE OFFICER'S CONTRIBUTIONS, AND REGARDLESS OF THE FATHER'S PERSONAL HABITS.

HOWEVER, IN VIEW OF THE PROVISIONS OF SECTIONS 1, 10, AND 11 OF THE DEPENDENTS ASSISTANCE ACT OF 1950, 64 STAT. 794-797, OUR DETERMINATION MAY COVER ONLY THE PERIODS FROM JULY 10, 1944, THROUGH DECEMBER 1, 1945, AND FROM NOVEMBER 1, 1948, THROUGH JULY 31, 1950. THE REMAINING PERIOD FROM AUGUST 1, 1950, THROUGH DECEMBER 31, 1950, IS FOR DETERMINATION BY YOUR DEPARTMENT. SEE B-61937, DATED JANUARY 11, 1950, AND 30 COMP. GEN. 282.

ACCORDINGLY, IT IS REQUESTED THAT THE DEPARTMENT OF THE ARMY TAKE ALL NECESSARY STEPS TO RECOVER SUCH IMPROPER PAYMENTS AS WERE MADE TO THE OFFICER. IN THAT CONNECTION ATTENTION IS INVITED TO THE PROVISIONS OF THE ACT OF JULY 15, 1954, 68 STAT. 482.

WE WILL APPRECIATE INFORMATION AS TO THE AMOUNTS COLLECTED BY THE DEPARTMENT OF THE ARMY.
