WE REFER TO YOUR LETTER RECEIVED IN OUR OFFICE ON DECEMBER 19, 1963, CONCERNING YOUR CLAIM FOR ADDITIONAL COMPENSATION AS AN EMPLOYEE OF THE DEPARTMENT OF THE ARMY, TRANSPORTATION CORPS, DURING THE PERIOD MARCH THROUGH JULY 1944.

WE REGRET THE INCONVENIENCE CAUSED YOU BY OUR FAILURE TO ASSOCIATE YOUR LETTERS OF NOVEMBER 4 AND DECEMBER 2, 1963, WITHOUT PREVIOUS RECORDS REGARDING YOUR CLAIM. SINCE YOU DID PRESENT YOU CLAIM WITHIN 10 YEARS AFTER IT HAD ACCRUED IT IS NOT BARRED BY THE ACT OF OCTOBER 9, 1940, CH. 788, 54 STAT. 1061, 31 U.S.C. 71A, AS INDICATED IN OUR CLAIMS DIVISION LETTERS OF NOVEMBER 15 AND DECEMBER 13, 1963, TO YOU.

WE HAVE REVIEWED OUR RECORDS PERTAINING TO OUR OFFICE SETTLEMENT OF FEBRUARY 10, 1950, BY WHICH WE ALLOWED YOUR CLAIM FOR OVERTIME COMPENSATION FOR THE PERIOD APRIL 1 THROUGH JULY 11, 1944, WHILE YOU SERVED AS CHIEF ENGINEER ON BOARD THE S.S. JOHN REID CAM UNDER THE PROVISIONS OF THE WAR OVERTIME PAY ACT OF 1943, APPROVED MAY 7, 1943, CH. 93, 57 STAT. 75.

THAT SETTLEMENT WAS FULLY CONSIDERED AND COMPLETELY REVIEWED BY US AS IS EVIDENCED BY THE LETTERS OF OUR OFFICE TO YOU DATED JANUARY 23, MARCH 8, APRIL 10 AND MAY 4, 1950, COPIES OF WHICH ARE ENCLOSED. FOR THE REASONS CONTAINED IN THOSE LETTERS YOU CLAIM FOR ADDITIONAL OVERTIME COMPENSATION ALTHOUGH NOT BARRED BY THE ACT OF OCTOBER 9, 1940, MAY NOT BE ALLOWED.

FURTHERMORE, AS INDICATED IN OUR LETTER OF MAY 4, 1950, AND SINCE YOU HAVE NOT PRESENTED ANY ADDITIONAL EVIDENCE IN THIS MATTER, WE PERCEIVE NO USEFUL PURPOSE WHICH COULD BE SERVED BY FURTHER CORRESPONDENCE WITH REGARD TO YOUR CLAIM.
