TO SECRETARY OF THE NAVY: REFERENCE IS MADE TO LETTER DATED JULY 27. THE INFORMATION AND FACTS DEVELOPED ARE SET FORTH IN A SUPPLEMENTAL REPORT OF INVESTIGATION. TWO COPIES OF WHICH ARE ENCLOSED. UPON REVIEW OF THE FACTS AS NOW DISCLOSED THE RECORD DOES NOT ESTABLISH THAT THE OFFICER'S MOTHER WAS NOT IN FACT DEPENDENT ON HIM FOR CHIEF SUPPORT DURING THE PERIOD JANUARY 1. THE RECORD SHOWS THAT THE MOTHER'S AVERAGE MONTHLY INCOME FROM SOURCES OTHER THAN THE OFFICER'S CONTRIBUTIONS WAS MORE THAN ONE-HALF OF HER AVERAGE MONTHLY LIVING EXPENSES. IT APPEARS THAT THE MOTHER WAS NOT IN FACT DEPENDENT ON THE OFFICER FOR CHIEF SUPPORT DURING THAT PERIOD. WILL BE APPRECIATED.

REFERENCE IS MADE TO LETTER DATED JULY 27, 1954, WITH ENCLOSURES, FROM THE BUREAU OF NAVAL PERSONNEL, FILE PERS B12-F1 347423/1310, CONCERNING INCREASED RENTAL AND SUBSISTENCE ALLOWANCE AND SAVED TOTAL COMPENSATION PAYMENTS MADE TO LIEUTENANT CARL C. DACE, USN, AS FOR AN OFFICER WITH A DEPENDENT MOTHER FOR THE PERIOD JANUARY 1, 1945, TO MARCH 31, 1950.

A FURTHER INVESTIGATION OF THE MATTER HAS BEEN MADE. THE INFORMATION AND FACTS DEVELOPED ARE SET FORTH IN A SUPPLEMENTAL REPORT OF INVESTIGATION, TWO COPIES OF WHICH ARE ENCLOSED. UPON REVIEW OF THE FACTS AS NOW DISCLOSED THE RECORD DOES NOT ESTABLISH THAT THE OFFICER'S MOTHER WAS NOT IN FACT DEPENDENT ON HIM FOR CHIEF SUPPORT DURING THE PERIOD JANUARY 1, 1945, TO DECEMBER 31, 1946. CONSEQUENTLY, NO FURTHER ACTION NEED BE TAKEN TOWARD RECOVERY OF THE INCREASED ALLOWANCE PAID TO HIM FOR THAT PERIOD.

HOWEVER, WITH RESPECT TO THE INCREASED ALLOWANCES AND SAVED TOTAL COMPENSATION PAID TO THE OFFICER FOR THE PERIOD JANUARY 1, 1947, TO MARCH 31, 1950, THE RECORD SHOWS THAT THE MOTHER'S AVERAGE MONTHLY INCOME FROM SOURCES OTHER THAN THE OFFICER'S CONTRIBUTIONS WAS MORE THAN ONE-HALF OF HER AVERAGE MONTHLY LIVING EXPENSES. HENCE, IT APPEARS THAT THE MOTHER WAS NOT IN FACT DEPENDENT ON THE OFFICER FOR CHIEF SUPPORT DURING THAT PERIOD, REGARDLESS OF THE AVERAGE MONTHLY AMOUNT OF HIS CONTRIBUTIONS.

FURTHER CONSIDERATION BY THE DEPARTMENT OF THE NAVY WITH A VIEW TOWARD RECOVERY OF THE AMOUNT OF THE IMPROPER PAYMENTS MADE TO MR. DACE, AND INFORMATION AS TO THE AMOUNTS COLLECTED, WILL BE APPRECIATED.
