Highlights

A firm requested reconsideration of its sustained protest of a Federal Prison Industries (UNICOR) contract award for office chairs. GAO had held that UNICOR failed to conduct meaningful discussions with the protester concerning certain evaluated problems found to be correctable. In its request for reconsideration, the protester contended that GAO improperly denied its contention that the awardee's product failed to meet the solicitation requirements as untimely. GAO held that the protester: (1) should have raised its contention regarding the acceptability of the awardee's product within 14 days after it knew the basis of protest; and (2) failed to show that the prior decision contained errors of fact or law that warranted reconsideration. Accordingly, the request for reconsideration was denied.
