A firm protested a Department of Veterans Affairs (VA) contract award for equipment testing and certification, contending that VA oral modification of the solicitation to delete certain costs was improper. GAO held that VA: (1) acknowledged the improper oral modification which amended a material aspect of the solicitation; (2) planned to resolicit its requirements rather than exercise the first contract option; (3) was not required to suspend contract performance, since the awardee had performed a significant portion of the base-year requirements; and (4) planned to reimburse the protester for its bid preparation costs. Accordingly, the protest was dismissed.
