A firm protested an Army contract award for rotor assemblies, contending that the Army: (1) improperly omitted its bid from bid opening; and (2) awarded the contract to an ineligible bidder. GAO held that: (1) the Army properly made award to the second low bidder; (2) it would not review the Army's affirmative responsibility determination, since the protester failed to provide evidence of bad faith or that the Army misapplied definitive responsibility criteria; and (3) the protester untimely filed its protest more than 10 days after it knew the basis of protest. Accordingly, the protest was dismissed.
