Highlights

A firm protested a proposed Natural Resources Conservation Service (NRCS) contract award. GAO held that it would not consider the protest, since: (1) the Small Business Administration (SBA) had sole jurisdiction to determine the protester's responsibility; (2) SBA determined that the protester was not eligible for a certificate of competency; and (3) the protester failed to show that NRCS or SBA acted in bad faith when they determined that the protester was not responsible. Accordingly, the protest was dismissed.
