A firm protested an Army solicitation for custodial services, contending that the: (1) Small Business Administration (SBA) unduly restricted competition by failing to release the procurement from the section 8(a) program; and (2) Army improperly decided to satisfy its needs through the 8(a) program. GAO held that: (1) SBA properly made a program and business judgment in connection with the section 8(a) program regarding the protester's business development needs; and (2) there was no evidence that the Army did not follow regulatory provisions before determining the appropriate procurement approach. Accordingly, the protest was dismissed.
