A firm requested reconsideration of its dismissed protest of a Military Sealift Command contract award for passenger vessel charter services. GAO had held that the protester was not sufficiently interested to protest the award, since it would not be in line for award even if its protest were sustained. In its request for reconsideration, the protester contended that: (1) GAO improperly determined that it was not in line for award; (2) the bidders' ranking could have changed after discussions and best-and-final offers; and (3) it was entitled to an evaluation preference under the Balance of Payments Program. GAO held that: (1) the protester presented no evidence that warranted reversal of the original decision; (2) the protester should have raised the Balance of Payments issue during its original protest; and (3) it would not reconsider the dismissal, since the matter was pending before a court of competent jurisdiction. Accordingly, the request for reconsideration was denied.
