A firm requested reconsideration of its dismissed protest of a Navy contract award for a cooperative research and development agreement. GAO had held that the protester: (1) untimely filed its protest of the Navy's alleged violation of law; and (2) did not establish a valid basis of protest. In its request for reconsideration, the protester contended that: (1) its supplemental protest of the Navy's violation of law was merely an extension of its original protest; and (2) GAO ignored its protest regarding the Navy's violation of the Competition in Contracting Act (CICA). GAO held that the: (1) two protests were distinct, since they concerned two different laws governing cooperative agreements; and (2) cooperative agreement award was not subject to CICA. Accordingly, the original decision was affirmed.
