[Protest of GSA Solicitation for Computer Software and Support Services]

A firm protested a General Services Administration (GSA) solicitation for computer software and support services, contending that: (1) the solicitation's data rights clause exceeded GSA minimum needs, since GSA accepted lesser data rights from a contractor under a previous contract; (2) the solicitation's requirement for additional products was ambiguous; and (3) GSA should have issued all or part of the solicitation as small business set-asides rather than abiding by its Financial Management Software Systems Multiple Awards Schedule. GAO held that: (1) the protest of GSA alleged actions under a prior contract was not relevant; (2) the solicitation requirement for additional products was not ambiguous; and (3) GSA reasonably determined not to set aside the solicitation for small businesses, since it was unlikely that it would receive two bids from responsible small businesses at fair market prices. Accordingly, the protest was denied.
