[Protest of HHS Refusal to Exercise Contract Option]

A firm protested the Department of Health and Human Services' (HHS) refusal to exercise an option under its contract, contending that it would be adversely affected by HHS resoliciting its requirements under the section 8(a) program. GAO held that the protester: (1) had no legal right to force HHS to exercise the contract option; and (2) could protest the Small Business Administration's decision to accept the section 8(a) contract. Accordingly, the protest was dismissed.
