Request for reconsideration of prior settlement certificate and decision which request merely restates arguments already made and considered and which shows no error of fact or law is denied.
DECISION
American Van Services, Inc., requests reconsideration of our decision, B-250492, of April 21, 1993, which affirmed our Claims Group settlement Z-2862118-7 dated August 25, 1992, upholding the Air Force's setoff of $218 from money otherwise owed to American to recover transit damages to a service member's household goods. We deny the request for reconsideration.
Our Office did not have a record of receiving the request for reconsideration, dated May 3, 1993, until it was faxed it to our Office on January 9, 1995.
American disagreed with its liability regarding several items in the shipment because of preexisting damage and the amount of the repair estimates. Its arguments, which were identical in both prior submissions to this Office, were fully considered in both the settlement action and our decision.
American, in its request for reconsideration, merely repeats the same arguments. We will deny a request for reconsideration where, as here, the claimant essentially restates arguments already considered by our Office and presents no evidence demonstrating an error of fact or law in the prior decision.
