A retired Navy member claimed an increased cost of living allowance (COLA) pursuant to a modified military regulation entitling members to a retroactive COLA increase, contending that the Navy improperly restricted him from receiving the increase, since it erred in determining his reassignment date. GAO held that it lacked authority to: (1) overturn the Navy's decision absent evidence that the Navy acted in an arbitrary or capricious manner; and (2) question the date of the claimant's reassignment, since the Navy has broad discretion over such matters. Accordingly, the claim was denied.
