A firm claimed reimbursement for its protest costs pursuant to its sustained protest against a Department of Veterans Affairs (VA) contract award for prime vendor services, contending that VA improperly refused to consider its claim because a federal court was reviewing the constitutionality of GAO authority to award protest costs. GAO held that it would not review the matter, since VA was considering the claim. Accordingly, the claim was dismissed.
