[FBI Employees' Claims for Back Pay]

The Federal Bureau of Investigation (FBI) requested a decision regarding two FBI employees' claims for back pay. The claimants contended that they were specifically assigned and required to perform higher level duties outside their job description. GAO held that the claimants were not entitled to backpay, since: (1) federal employees were only entitled to the salary of their appointed position even though they performed higher level duties; and (2) they did not provide any evidence of FBI regulation or a collective bargaining agreement that required temporary promotions for details to higher graded positions. Accordingly, the claims were denied.
