The General Services Administration (GSA) requested reconsideration of a sustained protest against its award of a lease. GAO had held that: (1) GSA conducted misleading and improper discussions under the procurement; (2) GSA improperly evaluated bids; and (3) the protester was entitled to reimbursement for its bid and protest preparation costs. GAO held that it would not consider the reconsideration request, since the protester under the original decision filed suit and raised the same substantive issues as those raised in the reconsideration request. Accordingly, the request for reconsideration was denied.
